The following are defined as public nuisances and are prohibited:
(1) 
Whatever is dangerous to human life or is detrimental to health and is contrary to the public health, safety or welfare because of sight, smell or creating any bad condition.
(2) 
Inadequate or unsanitary sewage or plumbing facilities, allowing sewage on lots, grounds, yards or any other place in the town, or creating smells that affect the ability of people to enjoy their property, contrary to the public health, safety or welfare or in violation of the codes and ordinances of the town and state.
(3) 
Whatever renders air, food, or drink unwholesome or detrimental to the health or enjoyment of human beings, public health, safety or welfare, or in violation of the codes and ordinances of the town and state.
(4) 
Any public nuisance known at common law or in equity jurisdiction or as defined by codes or town ordinances.

An offense under this article shall be deemed to be a misdemeanor and, upon conviction, is punishable by a fine in accordance with the general penalty provided in section 1.01.009 of this code for each offense.
