(a) 
Any person who shall violate any provision of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine in accordance with the general penalty provision in section 1.01.009 of this code. Each incident of noncompliance with this chapter shall constitute a separate offense punishable by a separate fine.
(b) 
A window fine schedule shall be established at the discretion of the town council.

It shall be unlawful for the engineer or any person operating or running any railroad engine over any railroad track or right-of-way to operate or run the same within the town in any way inconsistent with the Federal Railroad Safety Act (45 USC 434).
