The town council hereby specifically gives its written consent, as provided by section 54.016, Texas Water Code, to the creation of a municipal utility district within the corporation limits of the town. Said municipal utility district shall be created by authority of article XVI, section 59, of the state constitution and in accordance with the provisions of chapter 54, Texas Water Code. The municipal utility district shall be called Sunnyvale Municipal Utility District No. 1, the boundaries of such district being described in metes and bounds in the exhibit maintained on file in the office of the town secretary.

Where water and/or sewer service is deemed to be available, it shall be required that all citizens owning buildings and residences connect to said system. Said connections shall be made after payment of applicable tap fees and connection shall be made in accordance with town plumbing standards. “Availability” is defined as water and sewer for sewer service to be within three hundred (300) feet of the front, rear, or side property line.

The town does hereby assess an interest charge of eighteen percent (18%) per annum on any and all delinquent fees assessed for service rendered by the town, including sewer tap fees, water fees and any and all other fees on which an interest charge has not been previously assessed.
