The city acknowledges that effective November 1, 2020 the Texas Department of Licensing and Regulation, as authorized by the Texas Electrical Safety and Licensing Act (“act”), adopted the National Electrical Code, 2020 edition. The act applies to the city.
As provided in section 1305.201(d) of the act, all electrical work performed within the city must be installed in accordance with all applicable city ordinances.
As authorized by section 1305.201(c)(1) of the act, the 2020 NEC is hereby amended as follows:
(1)
Each reference to “jurisdiction” or location for insertion of name of jurisdiction shall mean the City of Nolanville, Texas.
(2)
For fees, commencing work without a permit, stop work orders, refunds, and reinspections, refer to the applicable provisions in sections 3.02.001 and 3.02.002 of this article or to the administrative provisions of the International Building Code as amended herein.
A license issued by the city is required to perform electrical work in the city. Such a license is valid only in the city and in any other municipality or region pursuant to a reciprocal agreement. All fees for such a license will be calculated in accordance with the fee schedule set by city council during the annual budget process or by minute entry. Except for the city license permit fee, no permit fee, registration fee, administrative fee, or any other fee shall be required from an electrician who holds a license issued under the act for any work performed in the city. However, the city shall collect any building permit fee that it otherwise requires.
It is an offense subject to the applicable penalties provided in section 3.02.002 of this article, for a person subject to the act to:
(1)
Violate the licensing requirements of the act;
(2)
Perform electrical work without a license to perform electrical work in this state, or to do so without a required city license to perform electrical work;
(3)
Employ an individual who does not hold the appropriate license required by the act; or
(4)
Falsify a certification of on-the-job training.
For just cause the city may suspend a license it has issued, and pursuant to section 1305.252 of the act it may request suspension for just cause of the state-issued license of a license holder working in the city.
