This article shall be known and may be cited as the nuisance ordinance of the city.

This article is adopted under the authority of the constitution and laws of the state, including particularly, but not limited to, the Texas Local Government Code.

The purpose of this article is to address outdoor storage, prohibit unauthorized outdoor burning and illegal dumping up to 5,000 feet outside the corporate limits of the city.
All decayable waste from public and private establishments, including but not limited to vegetable, animal and fish offal and animal and fish carcasses. The term does not include sewage, body waste and industrial byproducts.
Any substance which may pose unreasonable risk to the health and safety of operating or emergency personnel, the general public and/or the environment if it is not properly controlled during handling, storage, manufacturing, processing, packaging, use, disposal or transportation.
Any container, storage unit, or other portable structure that can or is used for the storage of personal property and which is located for such purposes outside an enclosed building.
Firefighters, police officers and employees of the city acting in the lawful discharge of an official duty are hereby authorized to enforce this article.
Authorized agents listed in subsection (a) of this section may order all activity of any kind stopped on any site where a violation of this article is found. Any person, including a workman on the site, who fails to comply with a stop-work order shall be guilty of a misdemeanor punishable as provided herein.
Any person, firm or corporation who violates any provision of this article or any order made under the authority of this article, or who causes or permits any such violation, or who fails to perform any act required hereunder or fails to take any action required, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than two thousand dollars ($2,000.00). Each and every day on which any violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
Illegal dumping of garbage, trash, rubbish, refuse, rubble, construction debris, hazardous waste, yard waste, or any such materials at a place that is not an approved solid waste site.
Uncontainerized outdoor burning of garbage, trash, rubbish, refuse, rubble, bulky waste, construction debris and hazardous waste unless such burning has been authorized by the fire chief.
Keeping, maintaining or storing any lawn equipment, household goods, junk, rubbish, refuse, debris or other objectionable, unsightly or unsanitary item outdoors where it is visible from the street or adjoining property.
It shall be unlawful to engage in activities declared to be nuisances in this article up to 5,000 feet outside the corporate limits of the city.

Portable home storage units are allowed in all residential districts for up to (14) days per calendar year. One additional fourteen (14) day extension to the initial term may be approved by the code official or authorized designee. Notification must be made to code compliance prior to placement. Portable home storage units must be placed wholly within the property lines of the lot being serviced and may not be placed on any public street or right-of-way.
