This article is adopted under the authority of the Constitution and laws of the state.

The purpose of this article is to protect the public health, safety, and welfare, to protect and preserve property values, and to maintain the natural beauty and atmosphere of the Texas Hill Country setting of the city by establishing rules and regulations for the use and enjoyment of public parks, greenbelts and recreational facilities, and to establish a parks and recreation committee tasked with assisting the city in meeting the recreational needs of the citizens.

Any person who violates any provision of this article, or fails to comply with any of the requirements thereof, after having been advised by an officer of the city to cease, may be required to leave any public park, public recreation area or greenbelt. Failure to comply with any provision of this article, or with an order given by any officer of the city, shall constitute a violation of this article.

Unless otherwise authorized by the city, it shall be unlawful for any person, including any owner or handler of an animal to:
(1) 
Mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, railings, paving, or paving materials, waterlines or other public utilities or parts or appurtenances thereof, signs, notices or placards, temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
(2) 
Deposit into any public park or public recreation area any rubbish, refuse, garbage or other material anywhere other than in containers provided for this purpose.
(3) 
Fail to deposit any rubbish, refuse, garbage or other material in receptacles provided for same in any public park or recreation area; where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.
(4) 
Bring any glass container into any public park or public recreation area.
(5) 
Drive any vehicle within any public park, recreation area, or greenbelt, except on designated roads and parking areas. Such prohibited vehicles include, but not limited to:
(A) 
Motor vehicles and trailers as defined in the Texas Transportation Code.
(B) 
Off-highway vehicles as defined in the Texas Transportation Code.
(C) 
Neighborhood electric vehicles, pocket bikes and minimotorbikes as defined in the Texas Transportation Code.
(D) 
Electric motor bikes and electric motorcycles.
(E) 
Exceptions: electric bicycles and electric personal assistive mobility devices as defined in the Texas Transportation Code.
(6) 
Have in his or her possession or discharge any fireworks within any public park or public recreation area.
(7) 
Camp or stay overnight anywhere within any public park or public recreation area.
(8) 
Cause, create or contribute to any noise which emits sounds beyond the person’s immediate individual picnic or use site, whether by shouting or singing, by using a radio, television or musical instrument or by operating mechanical or electrical equipment.
(9) 
Light, build or maintain a campfire or ground fire in any public park or public recreation area except as authorized by an appropriate permit. A permit is not required for the use of portable camp stoves or installed grills in picnic areas.
(10) 
Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition.
(11) 
Dig or remove any soil, rock, sand, stones, trees, shrubs, or plants or other wood or materials, or make any excavation by tool, equipment, blasting or other means or agency.
(12) 
Construct or erect any building or structure of whatever kind, whether permanent or temporary, or run or string any public service utility into, upon, or across such lands.
(13) 
Damage, cut, carve, mark, transplant, or remove any plant, or injure the bark, or flowers or seed of any tree or plant, dig in or otherwise disturb grass areas, or in any way injure the natural beauty or usefulness of the area.
(14) 
Hunt or molest, harm, frighten, kill, trap, pursue, tease, or shoot any animal, wildlife, reptile or bird; and remove or have possession of the young of any wild animal, or the nests or eggs thereof, or young of any reptile or bird.
(15) 
Post, paint, affix, distribute, delete, place, cast or leave about, any bill, billboard, placard, picket, handbill, circular, or advertisement.
(16) 
Enter an area posted as “closed to public” or posted with language indicating same.
(17) 
Fail to produce and exhibit a special event permit upon request of any authorized person who shall desire to inspect the same for the purposes of enforcing compliance with any ordinance or rule.
(18) 
Enter the park with any animal that is not a domesticated household-type pet, i.e. dog, cat, etc.
(19) 
Walk a dog or any other domesticated household pet without a leash or permit such animals to run loose at any time, or in any place, including the swim area, except that dogs may be off leash within the city park dog park area.
(20) 
Park a vehicle anywhere except on a designated parking area.
(21) 
Park a recreational vehicle, trailer of any type, or a truck, other than a pickup, on a designated parking area.
(22) 
Leave a vehicle standing or parked in established parking areas during hours when the park is closed.
(23) 
Solicit or undertake to operate any private business of any type.
(24) 
Loiter, camp, or otherwise occupy a park outside posted hours of operation, which are 6:00 a.m. to 10:00 p.m. during daylight saving time and 6:00 a.m. to 8:00 p.m. during standard time.
(25) 
Possess and/or consume any alcoholic beverages (including wine and beer).
(26) 
Access park property by means of motorized boat or personal watercraft except for emergency purposes.
(27) 
Operate watercraft, including boats, sailboats, jet skis, windsurf boards, canoes and other similar watercraft in marked swim areas. Swim marker buoys with signage shall be installed along the waterfront of the city park swim areas in order to clearly define these areas. Notwithstanding these prohibitions, launch and recovery of canoes and kayaks is allowed from areas designated for such. Canoes and kayaks shall be carried from the parking lot.
(28) 
Dive or jump off the cliffs at city park.
(29) 
Place, install, construct, or use a private boat dock on city-owned property adjacent to Lake Travis.
(30) 
While utilizing the city park dog park:
(A) 
Fail to maintain visual supervision over a dog;
(B) 
Leave a dog unattended;
(C) 
Fail to properly dispose of dog feces in an appropriate waste disposal container;
(D) 
Bring more than two dogs into the dog park at any one time;
(E) 
Smoke or eat in the dog park;
(F) 
Bring a female dog that is in season into the dog park;
(G) 
Fail to leash or unleash dog(s) in designated areas;
(H) 
Keep an unruly or rough playing dog in the dog park;
(I) 
Fail to maintain supervision over children; and
(J) 
Fail to ask permission before petting a dog belonging to another person.
(31) 
Enter any park or park facility in a vehicle except through open driveways designated for such use, and, as a pedestrian, to trespass through private property or to climb fences or closed gates to enter any park or park facility.
(32) 
Make entry onto adjoining private property from any park, park facility, or greenbelt owned and/or maintained by the city, with the following exceptions:
(A) 
The entrant has the permission of the property owner of the adjoining private property;
(B) 
The entrant is a public safety officer, an emergency services provider or an employee of the city acting pursuant to lawful instructions or in the lawful discharge of an official duty; or
(C) 
At the time of the offense, the boundary of the park, park facility, or greenbelt had not been adequately marked by signs indicating that such entry is prohibited, as described in section 16.02.005 of this article.

At the boundary between property owned and/or maintained by the city as park, park facility or greenbelt and any adjoining private property, the city may post signs that indicate the presence of such boundary, indicate that no authority or permission has been given for entry onto adjoining private property, and indicate that entry onto adjoining private property from property owned and/or maintained by the city constitutes an offense punishable by fine.

Any person who shall violate any of the provisions of this article, or shall fail to comply therewith or with any of the requirements thereof, shall be deemed guilty of a misdemeanor and shall be liable to a fine, and upon conviction of any such violation shall be fined a sum not to exceed $500.00; except that any person convicted of violating section 16.02.004(6) or (9) shall be fined a sum not to exceed $2,000.00; and each day any such violation shall be permitted to exist shall constitute a separate and distinct offense.
