It is unlawful for any person to take or attempt to take from any animal facility or from the possession of any officer or person in charge thereof, without his consent, any animal in such facility or in the charge of any such officer or person for the purpose of being impounded.

For the purposes of discharging the duties imposed by this chapter or other applicable laws and to enforce such, duly authorized representatives or employees may enter upon private property to the full extent permitted by law, which shall include, but not be limited to, entry upon private, unfenced property, except dwellings located thereon, when in pursuit of any animal which he has reason to believe is subject to impoundment pursuant to this chapter or other applicable laws.

If any animal found at large in violation of this chapter cannot be safely taken up and impounded, such animal may, if deemed necessary, be slain by any authorized police officer or animal control officer who examines the animal at the scene.

The animal control officer may destroy an animal in a humane method if the animal has been donated to the shelter with the request the animal be destroyed or if the animal is so sick or injured that its cure is considered by the animal control department to be impractical or if death is imminent. In either of such events, such destruction may be done immediately without notice or any waiting period.

The carcass of any animal, dead of disease or other cause and not slaughtered for food, shall be removed and disposed of by the owner, if known, and, if not known, the owner of the premises where such animal is found, at his own expense, within 24 hours after such death, according to such methods as may be approved of by the health officer.
