An inspection of a food service establishment should be performed at least annually, preferably semi-annually. Additional inspections of the food service establishment shall be performed as often as necessary for the enforcement of this article.

Agents of the city, after proper identification, shall be permitted to enter any food service establishment at any reasonable time for the purpose of making inspections to determine compliance with this article. The agents shall be permitted to examine the records of the establishments to obtain information pertaining to food and supplies purchased, received or used, or to persons employed.

Whenever an inspection of a food service establishment or commissary is made, the findings shall be recorded on the inspection report form and inspection record on file with the city. The inspection record will contain every score received by the establishment, including scores prior to reinspection. The inspection report form shall summarize the requirements of this article and shall set forth a weighted point value for each requirement. Inspectional remarks shall be written to reference, by section number, the section violated, and shall state the correction to be made. The rating score of the establishment shall be the total of the weighted point values for all violations, subtracted from 100. A copy of the inspection report form shall be furnished to the person in charge of the establishment at the conclusion of the inspection. The completed inspection report form is a public document that shall be made available for public disclosure to any person who requests it according to law.

The letter grade and/or numerical score from the inspection report will be presented to the food establishment on a food safety inspection grade placard as follows:

Two food safety inspection grade placards will be available depending on the size and type of operation, and the services it provides, as follows:
(1) 
Standard 8.5" x 11" colored cardstock; and
(2) 
5"x 7" color cardstock.
(c) 
The original food safety inspection grade from the health inspector shall be placed on the front door or in the front window at eye level (60" to 66" from the ground) to be clearly visible from the parking lot, sidewalk or right-of-way. All mobile food establishments must place the smaller placard in the adjacent window to the serving window. All drive-thru operations must have the smaller placard placed inside the drive-thru menu board. The placard must remain in place at all times during the business operations.
(d) 
Tampering or modifying the placard in any way from its original form will result in a fine in accordance with the general penalty provided in section 1.01.009 of this code for each violation.
(e) 
Should the placard become damaged or lost, the food establishment must immediately contact the city health inspector to receive a replacement. A food establishment not displaying a food safety inspection grade will be charged a 2nd reinspection fee as indicated in the schedule of fees in appendix A of this Code of Ordinances and undergo an additional health inspection regardless of the date of the most recent inspection.

Within three business days of the completion of an inspection, the owner of a food service establishment may request an owner-initiated inspection to be performed by the city. Such inspection will constitute a 1st reinspection as identified in the fee schedule in appendix A of this code. Such owner-initiated inspection shall be conducted within 5 business days of the request. After such owner-initiated inspection, the city will issue a new sanitation grade placard to the food service establishment and such placard shall be posted in accordance with this article. At least 12 months must elapse between any owner-initiated inspections for each food service establishment.

The food service establishment inspection report form, which is on file with the city, shall specify a reasonable period of time for the correction of the violations found. Correction of the violations shall be accomplished within the period specified, in accordance with the following provisions:
(1) 
If an imminent health hazard exists, such as complete lack of refrigeration or sewage backup into the establishment, the establishment shall immediately cease food service operations. Operations shall not be resumed until authorized by the city.
(2) 
All violations of four- or five-point weighted items shall be corrected as soon as possible, but in any event within ten business days following inspection. Within 15 business days after the inspection, the holder of the permit shall submit a written report to the city stating that the four- or five-point violations have been corrected. A follow-up inspection shall be conducted to confirm correction.
(3) 
All one- or two-point weighted items shall be corrected as soon as possible, but in any event by the time of the next routine inspection.
(4) 
When the rating score of the establishment is less than 60, the establishment shall initiate corrective action on all identified violations within 48 hours. One or more reinspections will be conducted at reasonable time intervals to ensure correction.
(5) 
In the case of temporary food service establishments, all violations shall be corrected within 24 hours. If violations are not corrected within 24 hours, the establishment shall immediately cease food service operations until authorized to resume by the city.
(6) 
All reinspections shall necessitate payment of reinspection fees in the amounts specified in the fee schedule in appendix A of this code.

The food service establishment inspection report shall state that failure to comply with any time limits for corrections may result in cessation of food service operations. An opportunity for appeal from the inspection findings and time limitations will be provided if a written request for a hearing is filed with the city management within ten calendar days following cessation of operations. If a request for a hearing is received, a hearing shall be held within 20 calendar days of receipt of that request.

Whenever a food service establishment is required under the provisions of this article to cease operations, it shall not resume operations until such time as a reinspection determines that conditions responsible for the requirement to cease operations no longer exists. Opportunity for inspection shall be offered within a reasonable time.
