There shall be a City Manager appointed by the Mayor with the
advice and consent of six (6) out of eight (8) members of the entire
City Council. The City Manager and the Acting City Manager, should
the position of City Manager become vacant, shall be appointed solely
on the basis of such person's executive and administrative qualifications.
The City Manager may be removed with the consent of six (6) out of
eight (8) members of the entire Council. The City Manager shall be
compensated as established by the Council. The person appointed to
the office of the City Manager shall become a resident of and reside
within the City limits within one (1) year of appointment and possess
qualifications provided by ordinance. The residency requirement may
be waived by a three-fourths (3/4) vote of the entire Council.

The City Manager shall be the chief administrative officer of
the City. The City Manager shall be responsible to the Mayor and Council
for the administration of all City affairs placed in the City Manager's
charge by or under this Charter. The City Manager shall have the following
powers and duties:
(a) Appointment and removal of employees. The City Manager shall appoint and, when the City Manager deems it necessary for the good of the City, suspend or remove City employees and appointive administrative officers, including the City Clerk, provided for by or under this Charter, except as otherwise provided by law, this Charter or the Personnel Code and regulations thereunder adopted pursuant to Section
6.2. The City Manager may authorize any administrative officer who is subject to the City Manager's direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency.
(b) Administration of departments. The City Manager shall direct and
supervise the administration of all departments, offices and agencies
of the City, except as otherwise provided by this Charter or by law.
(c) Attend City Council meetings. The City Manager shall attend all Council
meetings unless excused by the Mayor and shall have the right to take
part in discussion but may not vote. The City Manager shall receive
notice of all special meetings.
(d) Enforcement of laws. The City Manager shall see that all laws, provisions
of this Charter and acts of the Council subject to enforcement by
the City Manager, or by any person subject to the City Manager's direction
and supervision, are faithfully executed.
(e) Budget and capital program. The City Manager shall prepare and submit
a recommended annual budget and capital program to the Mayor and Council.
(f) Finance and administrative report. The City Manager shall submit
to the Mayor and Council, and make available to the public, a complete
report on the finances and administrative activities of the City at
the end of each fiscal year.
(g) Other reports. The City Manager shall make such other reports as
the Council may require concerning the operations of City departments,
offices and agencies subject to his/her direction and supervision.
(h) Report of financial condition of the City. The City Manager shall
keep the Mayor and Council fully advised as to the financial condition
and future needs of the City and make such recommendations to the
Council concerning the affairs of the City as the Mayor or Council
deems desirable.
(i) Execution of documents. Except as otherwise provided by the Council,
the City Manager shall sign on behalf of the City all instruments
required to implement the Council-approved budget, all documents related
to the administration and management of employees, all administrative
policies, all capital project contracts and professional services
agreements, and all contracts and agreements related to the administration
and management of government business.
(j) Other duties. The City Manager shall perform such other duties as
are specified in this Charter or as may be required by the Council.

By letter filed with the City Clerk, the City Manager shall
designate a qualified person to exercise the powers and perform the
duties of the City Manager during the temporary absence or disability
of the City Manager. During such absence or disability, the Mayor
with the consent of the Council may revoke such designation at any
time and appoint another qualified person to serve.

The City Manager shall receive a confidential performance evaluation
from the Mayor and the City Council at least once each year.
