As used in this division, the following words have the meaning indicated:
Established fee
means a fee that is created, set, set forth, specified, established, adopted, listed, scheduled or authorized in the Horizon City Municipal Code or any ordinance of the city for any city service, application, permit or license provided or issued by the city, or is a fee, cost or special expense charged by the city.

(a) 
The city council is authorized to set the amount of an established fee by identifying a fee that is created, set, set forth, specified, established, adopted, listed, scheduled or authorized in the Horizon City Municipal Code or any ordinance of city for any city service, application, permit or license provided or issued by the city, or is a fee, cost or special expense charged by the city, and setting the amount or a new amount for such fee through a schedule as part of an ordinance adopting a city budget or as a schedule adopted as a resolution of the council.
(b) 
Such established fees, in the amount as set pursuant to the process established in subsection (a) of this section, shall then apply to the identified fee for a city service or application, permit or license issued by the city, or for a fee, cost or special expense charged by the city, beginning on the effective date of an applicable budget ordinance, or the duly adopted by resolution of the council which shall be considered an amendment to the budget ordinance, and the established fees shall control as set forth in sections 1.02.063, 1.02.064 and 1.02.065 herein.

(a) 
All established fees set by resolution pursuant to the authority and procedures prescribed by this division shall apply and control over any different specified amount of an established fee previously set or contained within the annual budget ordinance of the city.
(b) 
It is intended and established by the city council that this division, and the established fees set pursuant to the authority and procedures prescribed by this division, shall control over the provisions of the Horizon City Municipal Code and all other ordinances of the city, and once a particular established fee is set pursuant to the procedures in this division, any Municipal Code or ordinance provision relating to that particular fee that sets forth an amount of a fee that is different from the established fee is hereby superseded, and the provisions of such ordinance or Municipal Code provision shall be amended and interpreted so as to require the payment of the established fee for the applicable city service, application, permit or license, or fee, cost or special expense charged by the city.

The established fees as set forth in a budget ordinance or in a schedule adopted by resolution of the council shall apply as set. Any fee specified within the Horizon City Municipal Code or another ordinance of the city that is not specified or set in a budget ordinance or a schedule adopted as a resolution of the council shall remain in full force and effect as provided in the Horizon City Municipal Code or in such other ordinance, even if such other ordinance has been codified without including the fee amount in the code.
