The fund shall be used only for the purpose of financing the purchase of security devices and/or services for the building or buildings housing the municipal court of the city. Security devices and/or services shall include any and all items described in article 102.017(d) of the Code of Criminal Procedure.

(a) 
A defendant convicted in a trial for a misdemeanor offense in the municipal court of the town shall pay a $3.00 security fee as costs of court. A person is considered convicted if:
(1) 
A sentence is imposed on the person;
(2) 
The person receives community supervision, including deferred adjudication; or
(3) 
The court defers final disposition of the person’s case.
(b) 
The clerk of the municipal court shall collect the costs and pay them to the municipal treasurer or other official of the town who discharges the duties delegated to the municipal treasurer for deposit in a fund to be known as the municipal court building security fund.
