It shall be the duty and obligation of all owners, occupants and users of real property abutting upon streets in the city, at their own cost and expense, to maintain and keep the sidewalks and paving laid thereon bordering their property at curb-grade and level and free of depressions, excavating, deviations, inequalities, obstacles, obstructions or encroachments, natural or artificial, above or below ground level, or which overlap, impinge upon or appropriate any part of the sidewalk area or the space eight (8) feet above it; and generally and in every manner to keep such sidewalks in a safe, adequate and indefective condition, so that they are easily accessible to and may be freely and safely used by the public for travel by foot.

Where and when, by reason of a violation of any of the foregoing provisions, injury or damage is occasioned or inflicted upon any person, whether on the sidewalk or in the street, primary liability for all such injury or damage shall rest upon the owner, occupant and user of the property abutting upon such defective sidewalk.

It shall be unlawful for a person to, in any manner, obstruct the view of a pedestrian of any sidewalk, public easement or street in the city by placing, depositing, or suffering to remain thereon, or permitting any of his servants, employees, or persons under his control to deposit, place or suffer to remain thereon, any goods, wares, merchandise, material, vehicle, or other objects whatever, without first obtaining a permit therefor from the city manager.

Any such application for permit shall be filed with the city manager seventy-two (72) hours prior to the date that said permit is to be issued in order that the city manager may have sufficient time to investigate the feasibility of issuing said permit. Any permit issued under this section shall expire seventy-two (72) hours after it has been issued.

Any person who disagrees with the decision of the city manager may appeal such, in writing, to the city council within ten (10) days after the permit was denied or granted.

Any person who shall violate or fail to comply with any provisions of this part shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine as provided in section 1.01.009 of this code.
