Any person or commercial establishment violating any of the provisions of this division shall be deemed guilty of a misdemeanor, and such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this division is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine as provided in section 1.01.009 of this code; provided [that, if a penalty is provided] for the same or a similar offense under the laws of the state, then the maximum penalty for violation as provided by state statute shall be the maximum penalty under this code.

(a) 
Every person whose work brings him or her in contact with the production, handling, storage, or transportation of food or food products, including retail food establishment workers whose work entails a likelihood of such person contaminating food or food-contact surfaces, shall hold a health card issued by a licensed physician in compliance with this division.
(b) 
Retail food establishment workers whose work is solely and exclusively in an area where there is no reasonable likelihood of contaminating food or food-contact surfaces, such as cashiers or sackers, are exempt from this section. Such exemption shall cease if said worker is in fact working in an area where food or food-contact surfaces may be contaminated.
(c) 
The health card shall certify to the fact that not more than fifteen (15) days prior to issuance proper examinations have been made that said person is free of tuberculosis, and that said person is not a carrier of any disease capable of being spread through the handling of food and food products.

It shall be unlawful for any physician to issue to any person a health certificate required under this division without seeing said person personally, to make the determination that said person is free of tuberculosis and is not a carrier of any disease capable of being spread through the handling of food and food products. Any physician issuing any such health certificate shall administer to each person to whom a health certificate is granted a tuberculin skin test or chest X-ray.

Each health certificate issued under this division shall be valid for twelve (12) months.

The records of the examination by a physician under the provisions of this division, together with the test results, shall be kept in the files of said physician for a period of twelve (12) months, and shall be exhibited and shown to the health authority or his authorized representative upon request of said health authority or his authorized representative.

The health authority, or his assistant, may require the holder of any health certificate to be reexamined at any time such holder of such certificate is known or suspected by the health authority to be afflicted with tuberculosis or any disease capable of being spread through the handling of food, food products or drinks.

It shall be unlawful for any manager, proprietor or owner of any establishment where food, food products or drinks are prepared, handled, served or dispensed to knowingly permit any person who is afflicted with tuberculosis or any disease capable of being spread through the handling of food, food products or drinks, to prepare, handle, serve or dispense any food, food products or drinks on or from said premises.

The owner, lessee or operator of any food establishment upon whose premises or in whose place of business any case of infectious, contagious or communicable disease occurs shall notify the health authority within twenty-four (24) hours.
