(a) 
The fire department is created for the city.
(b) 
The fire department shall consist of the chief of the fire department and such personnel as may be necessary to perform its duties.

(a) 
(1) 
The fire chief shall be elected by the members of the fire department and presented to the city council for final approval.
(2) 
He or she shall work under the general supervision of the city administrator in accordance with the codes, ordinances and policies of the city.
(3) 
He or she shall supervise the full-time firefighters and all volunteer firefighters of the fire department.40 * Charter reference–Fire department, sec. 8.02.
(b) 
The fire chief shall have general supervision and control over the fire department.

(a) 
The office of fire marshal is hereby created.
(b) 
The city council shall designate a qualified individual to exercise the powers and perform the duties of fire prevention engineer and fire marshal, as provided in the 2006 International Fire Code, as amended, and heretofore adopted by ordinance.
(c) 
The fire marshal shall be properly qualified for the duties of his or her office and shall perform the duties required by the 2012 International Fire Code, as amended, and any other duties delegated by the fire chief or city manager. Such duties shall include, but not be limited to, serving as chief arson investigator and as the official in charge of fire prevention enforcement.
