This article shall be known as the garbage ordinance of the city.

For the purpose of this article, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
Premises.
Business houses, offices, theaters, hotels, restaurants, cafes, tourist camps, apartments, clinics, sanitariums, rest homes, service stations, schools, wrecking yards, vacant lots and all places within the city limits where trash and rubbish accumulates in ordinary quantities.
Trash and rubbish.
Tin cans, bottles, scraps of iron, tin wire or other metals from premises within the city limits.

(a) 
It shall be the duty of every person, firm or corporation owning, managing, operating, renting or using any premises to place all rubbish and trash from the premises in suitable containers of reasonable size, provided the weight does not exceed 40 pounds. Trash and rubbish containers shall be placed inside the property line at the edge of the alley, and where there is no fence [sic] with an alley gate, trash and rubbish cans shall be placed inside of the fence at the side of the alley gate; if there is no alley gate or no alley, the trash container shall be placed at such a point as the proper agent of the city shall find and designate to be the most convenient for collecting and removing.
(b) 
Trash and rubbish containers shall not be placed at the point of collection before 7:00 p.m. prior to the designated day of collection and any trash or rubbish containers shall be removed from the point of collection by 10:00 p.m. on the day of collection and stored behind the front building line of the residence.
(c) 
Bulk trash items eligible for pick up shall be placed at the curb no earlier than seven (7) days prior to the scheduled pickup date.
(d) 
Any person violating any of the provisions of subsection (b) or subsection (c) of this section shall be deemed guilty of a class C misdemeanor upon conviction and shall be fined, except as otherwise provided herein, in a sum not to exceed $500.00 for each offense, and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.

Heavy dead animals shall be disposed of at the expense of the owner or person having control of the animal.

(a) 
Brick, broken concrete, lumber, dirt, automobile frames, discarded automobile tires, dead trees, tree limbs and other bulky materials shall be disposed of by the owner.
(b) 
Waste oil from garages and filling stations shall be disposed of by the owner of the business.

The city truck will not make collection of rubbish where the same is not prepared for collection and placed as designated by the terms of this article.

The placing of garbage, trash, rubbish or any article, thing or material in any street or alley within the city limits is prohibited.

Any business or commercial establishments or any residences which do not require and do not receive rubbish or trash collection service shall be assessed the monthly charge, as such service is being provided and is available if they choose to use it.

It shall be unlawful for any person, firm or corporation to use city streets or alleys in the city for the purpose of conducting a commercial trash or garbage hauling business without first securing from the city council a trash or garbage hauling franchise for the purpose of operating the trash or garbage hauling business.
