(a)
It shall be unlawful for any person to make any excavation or embankment in any street, avenue, alley or public easement in the city, other than for the purpose of erecting utility poles, towers and fixtures, without first applying for and obtaining a written permit from the building official.
(b)
Public utility companies may perform emergency work during the nighttime or at times during which the city hall is closed, without the permit required by this section, but it will be necessary for any such public utility company to obtain the permit the next day following such work, or the next day the city hall is open for business.
