The term “automotive wrecking and salvage yard”
as used in this division shall mean any lot or parcel of land upon
which three (3) or more junked, wrecked, abandoned or partially dismantled
motor vehicles, or parts thereof, are kept, stored or dismantled for
use in automotive repair or rebuilding and/or for being offered for
sale as whole units, salvaged parts or scrap metal.

(a) Every
automotive and wrecking salvage yard within the city shall be completely
surrounded and enclosed by a solid fence or wall as described herein.
Each side of an automotive wrecking and salvage yard, which side extends
generally parallel to and within one hundred (100) feet of any public
street, shall be bounded by a solid fence or wall at least eight (8)
feet in height. All other sides of an automotive wrecking and salvage
yard shall be bounded by a solid fence or wall at least six (6) feet
in height. Every fence or wall required by this section shall be constructed
of wood, masonry, corrugated sheetmetal, chainlink with slats as hereinafter
provided, or any combination thereof. The fences or walls required
by this section shall be constructed and maintained so that the outer
surface thereof is continuous and without spaces, gaps or holes; provided,
however, galvanized chainlink fencing with wood or metal slats or
strips placed through all links of such chainlink fence so as to create
a visual barrier shall be permissible. All fences or walls required
by this section shall extend downward to within three (3) inches of
the ground and shall test plumb and square at all times.
(b) Openings
in any fence or wall required by this section which are necessary
to permit reasonable access to the automotive wrecking and salvage
yard shall be equipped with solid gates constructed and maintained
in accordance with the requirements in this section for fences or
walls. Such gates shall be closed and securely locked at all times
except during normal daytime business hours.
(c) No
fence or wall required by this section shall be located within the
front, side or rear yard required by the city zoning ordinance for
the zoning district in which the automotive wrecking salvage yard
is located. All fences and walls required by this section shall be
constructed and maintained with a twenty-foot cutback at each corner
abutting a street intersection so that the fence does not cover the
corner portion of any lot abutting a street intersection measured
across the lot corner from points along the property lines twenty
(20) feet from the property corner or projected property corner.

It shall be unlawful for the owner, operator, agent or employee of an automotive wrecking and salvage yard to maintain, store, display or work on any wrecked, junked or partially dismantled motor vehicle or parts thereof except within an area completely enclosed within fences or walls as described and required in section
4-12-32.

No complaint or charge shall be filed in court against any person
or business entity for a violation of any of the provisions of this
division until and unless such person or business entity shall have
failed to correct and eliminate such violation within a period of
ninety (90) days following written notice of such violation sent by
certified mail or delivered in person by the city to such person or
business entity.
