Any person that violates this division shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine in accordance with the general penalty in section 1.01.009 of this code.

(a) 
It shall hereafter be unlawful for any person to drive or operate a motor vehicle upon any street, roadway, or highway in the city limits at a speed greater than reasonable and prudent under the conditions then existing, having regard to the actual and potential hazards when approaching and crossing an intersection or railway grade or crossing, when approaching and going around a curve, when approaching a hillcrest, when traveling upon any narrow or winding roadway, or when special hazard exists with respect to pedestrians or other traffic or by reason of weather or highway conditions, and, in every event, speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle, or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care.
(b) 
All of the streets of this city, and all portions of any such streets, are hereby declared to be public streets, and the driving or operating of any motor vehicle on or along any portion of any street of this city at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this division and the schedules contained in section 22.07.001, shall be guilty of a misdemeanor. The use of the word “speeding” shall be sufficient to designate the offense and shall mean that a motor vehicle has been driven upon a public street at a greater rate of speed than that fixed by city ordinance for the street and for the zone thereof that such motor vehicle was so being driven upon, if zoned.
(c) 
In prosecution under this section for the offense of speeding, the complaint, if in other respects sufficient in form, shall, as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in the city commit the offense of speeding.

The state traffic laws regulating the speed of vehicles shall be applicable upon all streets within this city, except as this section, as authorized by state law, declares and determines upon the basis of an engineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain areas, in which event it shall be unlawful for any person to drive a vehicle at a speed in excess of any speed so declared in this section when signs are in place giving notice thereof. The maximum speed limit shall be set forth upon those streets or portions thereof as described and listed in section 22.07.001 and are declared to be the specified speed limits for the purposes of this section.

(a) 
All streets, direction of travel, location and speed limit of school zones shall be identified, defined and amended by the city’s engineering department, pursuant to the rules and regulations as detailed in the Texas Manual on Uniform Traffic-Control Devices (TMUTCD).
(b) 
The city may install or remove warranted school zones if deemed necessary by the city’s engineering department. The times of operation of each school zone shall be established by the city engineer.
(c) 
To request amendment to the city’s school zones, the following items must be satisfied:
(1) 
Request for study.
(A) 
Request must be made by either the principal of the school or the school district’s authorized representative.
(B) 
Each request must include a name, address and phone number of the school principal, the school name, and school hours.
(C) 
Application for study must be obtained from the city’s engineering department (exhibit A, appendix C attached to Ordinance O-19-01-03-8A).
(D) 
Application must be returned to the city’s engineering department and must contain the following:
(i) 
The requested street name.
(ii) 
The boundary of the street segment.
(iii) 
Associated school name.
(iv) 
Grade levels at the school.
(v) 
Hours of school operation.
(vi) 
Crossing guard locations.
(2) 
Eligibility.
(A) 
The requested street must meet the following criteria:
(i) 
The street must border the school’s property line or have direct visibility of the school from all points within the zone.
(ii) 
The school must be clearly defined as an elementary, middle/junior high school, ninth grade center, or high school.
(iii) 
The school zone must be on a street that has a functional classification or collector or higher, unless it is a school boundary street or if the school is visible from all points in the zone.
(iv) 
School zones on local streets that are not boundary streets will be considered on a case-by-case basis.
(B) 
Only those requests meeting all eligibility requirements will proceed. Reapplication will not be considered unless there have been significant changes in conditions.
