Any person, firm or corporation violating any of the provisions
of this article shall be deemed guilty of a misdemeanor, and upon
conviction shall be fined.

It shall be unlawful for any person, firm or corporation to
accumulate or store on any premises within the corporate limits of
the city more than five cubic yards of grass, paper, cotton burrs,
shavings or any other bulky combustible matter, unless such matter
be stored within a fireproof building constructed of brick, concrete,
stone or other fire-resistant construction, the roof of which shall
be of noncombustible or fire-resistant material.

It shall be unlawful for any person, firm or corporation to burn or destroy any of the combustible material within the corporate limits of the city, except to burn same in an approved incinerator, the specifications of which must meet the approval of the governing body of the city, which approval must be shown by a proper permit issued by the city, or in the case of operators of cotton gins as provided in section
5.04.004 of this article.

It shall be unlawful for any person, firm or corporation operating a cotton gin, within the city limits, to burn or destroy any cotton burrs, leaves, parts of cotton stalks, waste lint or other combustible matter mentioned in section
5.04.002 of this article, within the city limits, except to burn the same in an incinerator.

Such incinerator shall be a shaped structure standing upright
on a suitable foundation and not less than twenty (20) feet in diameter
nor less than eighteen (18) feet in the height of its main walls,
and such walls shall be constructed of heavy iron or other fire-resistant
material. Such incinerator shall be provided with two (2) “clean-out”
doors near the bottom of such structure and placed on opposite sides
of such structure from each other. Such incinerator shall be subject
to inspection for approval or disapproval by the governing body of
the city, or under its direction, and when so approved, a proper permit
shall be issued for its use.
