[Adopted 11-9-1993 by Ord. No. 133]
Caernarvon Township, Berks County, Pennsylvania, hereby adopts, for the purpose of establishing rules and regulations for the construction, alteration, enlargement, repair, demolition, removal, maintenance and use of all building and structures, including administration, building permits and penalties, the Building Code known as the "BOCA National Building Code/1993 Twelfth Edition," together with any and all future revisions and editions thereto as may from time to time be adopted by the Building Officials and Code Administrators International, Inc., save and except such portions thereof as are hereinafter deleted, modified or amended, as fully as if set fourth at length herein.
The following sections are hereby revised as follows:
A. 
Section 101.1. The words "Caernarvon Township, Berks County, Pennsylvania," shall be inserted where the words "names of jurisdiction" appear in brackets therein.
B. 
Section 104.2. Add the following to the existing section:
The Code Official shall be known as the Building Inspector and shall be appointed annually by the Township Board of Supervisors at their organizational meeting. The Building Inspector shall be a person with knowledge in the building trades, engineering, architecture or building design and shall have a minimum of five years building experience.
C. 
Section 107.7. This section shall be reworded as follows:
Engineering Details: The Code Official may require to be filed adequate details of structural, mechanical and electrical work, including computations, stress diagrams and other essential technical data. All engineering plans and computations shall bear the signature and seal of the engineer or architect responsible for the design as required by Section 108.1.
D. 
Section 112.3.1. This section shall be reworded to read:
A fee for each plan examination, building permit, certificate of occupancy and inspection shall be paid in accordance with the schedule of fees adopted by the Township Board of Supervisors, by resolution, and as may be altered or amended, from time to time.
E. 
Section 114.1. This section shall be reworded as follows:
All design for new construction, alteration, repair, expansion, addition or modification work for any building or structure requiring submission and approval from the Commonwealth of Pennsylvania, Department of Labor and Industry, shall be prepared by a registered architect or professional engineer licensed in the Commonwealth of Pennsylvania.
All plans, computations and specifications required for a building permit application for such work shall be prepared by or under the direct supervision of a registered architect or engineer and bear that architect's or engineer's signature and seal in accordance with the state's statutes and regulations governing the professional registration and certification of architects or engineers.
F. 
Section 116.4. This section shall be reworded as follows:
Any person who shall violate any provision of this article or who shall fail to comply with any requirement thereof, or who shall erect, construct alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, or continue any work in violation of a stop-work order shall, for each and every such violation, be guilty of an offense and, upon conviction thereof, shall be sentenced to pay a fine of not more than $500 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than 30 days. Each violation of any provision of this Code, and each day the same continues, shall be deemed a separate offense.
G. 
Section 117.2. Delete in its entirety.
H. 
Section 121.2.1. Delete existing subsection and substitute the following:
The Board of Appeals shall be appointed by the Board of Supervisors, on an individual basis, as required. The Board of Appeals shall consist of five residents of the municipality.
I. 
Section 121.2.1. Delete existing subsection and substitute the following:
Each member shall meet the qualifications as established by the Board of Supervisors and shall be knowledgeable in building construction.
J. 
Section 121.2.2. and 121.2.3. Delete subsections in their entirety.
K. 
Section 121.2.6. Delete subsection and substitute the following:
Compensation of the members shall be determined by the Board of Supervisors.
L. 
Section 3102.3. Add the following:
The Code Official may require that any person erecting, installing, removing, rehanging, or maintaining any sign over public property for which a permit is required under the provisions of this Code file an approved bond or an insurance policy for public liability and property damage, in an amount to be determined by the Township Solicitor.
Ordinance No. 109-A enacted December 13, 1990, which adopted the BOCA National is repealed.
