There is hereby adopted by the Board of Supervisors of Caernarvon Township, Berks County, Pennsylvania, the BOCA National Plumbing Code 1993, 9th Edition, as published by the Building Officials and Code Administrators International Inc., as the Plumbing Code within Caernarvon Township, State of Pennsylvania, for the control of buildings and structures as herein provided and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted, made a part hereof, as if fully set out in this article with the additions, insertions and changes set forth in § 240-14 of this article.
Ordinance No. 74 of Caernarvon Township, which adopted a prior edition of the BOCA Plumbing Code and all other ordinances and parts of ordinances inconsistent herewith are hereby repealed.
The following sections are hereby revised as follows:
A. 
Section P-101.1. Insert "Caernarvon Township" in the space provided.
B. 
Section P-108.1. Delete this section and substitute the following:
Plumbing work shall not be commenced until a permit for such work has been issued by the Code Official. A permit is not required for repairs that involve the working parts of a faucet or valve, the clearance of stoppages, the repairing or replacement of defective faucets or valves or the replacement in kind of existing fixtures, piping or systems. A permit shall be obtained prior to the start of work for the installation of new fixtures or modifications of any existing system when additional fixtures and/or piping is installed.
C. 
Section P-108.6.1. Delete this section and substitute the following:
The site plan shall indicate the location of the individual on-lot sewage disposal system where public sewer is not available. All individual on-lot sewage systems shall be designed, installed and maintained as required by Title 25, Chapter 73, Standards for Sewage Disposal Facilities, of the Pennsylvania Code.
D. 
Section P-109.1. Add the following sentence:
Action by the Code Official on all applications for permits shall be taken within 30 days.
E. 
Section P-113.2. The fees for all plumbing work shall be as established from time to time by resolution of the Board of Supervisors of Caernarvon Township and as set forth in a Fee Schedule.[1]

F. 
Section P-116.4. Delete this section and substitute the following:
Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair plumbing work in violation of the approved construction documents or directive of the Code Official or of a permit or certificate issued under the provisions of this Code shall be guilty of a summary offense, punishable by a fine not exceeding $600 and, upon failure to pay said fine, to imprisonment not exceeding 30 days. Each day that a violation continues after notice has been served shall be considered a separate offense.
G. 
Section P-117.2. Delete in this section and substitute the following:
Any person who shall continue to work in or about the structure after having been served with a stop-work order except such work as that person is directed to perform to remove a violation or unsafe condition shall be liable to a fine for a violation as set forth in Section P-116.4.
H. 
Section P-121. Delete this section, including Sections P-121.1 through P-121.7, and in its place substitute the following:
Plumbing Board of Standards and Appeals. There is hereby established a Plumbing Board of Standards and Appeals which shall consist of five members. One member shall be a member of the Township Board of Supervisors, two members with the status of master plumber and two members being residents of the Township. Each of said members shall be appointed by the Board of Supervisors and shall serve for a term of two years. The Board shall make reasonable rules and regulations governing procedures for the issuance of plumbing permits, the regulation of plumbers within the Township and the inspection of plumbing work. The Board shall hear applications for appeals from persons who appeal any decision of the Code Official. The application shall be based on a claim that the true intent of this Code or the rules adopted hereunder have been incorrectly interpreted, the provisions of this Code do not fully apply or an equally good or better form of construction is proposed. The Board shall make reasonable rules and regulations governing its appeal procedure. All hearings before the Board shall be open to the public. Decisions of the Board shall be in writing and shall adopt, modify or reverse the decision of the Code Official. Any person aggrieved shall have the right to appeal the decision of the Plumbing Board of Standards and Appeals to the Court of Common Pleas of Berks County in the manner provided in compliance with the Local Agency Law.[2]

I. 
Section P-304.3. Add the numeral "150" in the space provided.
J. 
Section P-309.4. Delete the first sentence and substitute in its place the following:
Water surface piping shall be installed below recorded frost penetration but not less than three feet six inches below grade.
K. 
Section P-309.5. Delete this section and substitute the following:
Building sewers that connect to individual on-lot sewage systems shall be installed according to Title 25, § 73.21, of the Pennsylvania Code. Building sewers shall be a minimum of 42 inches below grade.
L. 
Section P-803. Delete this section and substitute the following:
All roofs, paved areas, yards, courts and courtyards shall drain into a separate storm sewer system or into an approved place of disposal. All storm drainage and storm sewers shall drain away from the building. Storm sewer and/or stormwater management facilities shall be constructed in accordance with Chapter 425, Subdivision and Land Development, of the Code of Caernarvon Township, where applicable. When a building is constructed on a lot approved as part of a subdivision and/or land development plan, all facilities indicated on the plan pertaining to said lot shall be constructed.
M. 
Section P-1004.4. Delete this section and substitute the following:
Grease interceptors shall conform to PDI G101 listed in Chapter 19 and shall be approved by the Caernarvon Township Municipal Sewer Authority prior to installation.
N. 
Section P-1213 of the Code is amended to add the following language:
Notwithstanding this section and any other conflicting portions of the Code, floor drains are prohibited in any industrial and commercial building constructed after the effective date of this subsection, except in restroom facilities.

Nothing in this article or in the Plumbing Code adopted hereby shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed by this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article. It is further declared the intent of the Board of Supervisors as follows:
A. 
If a court of competent jurisdiction declares any provision of this article to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid or ineffective and all other provisions of this article shall continue to be separately and fully effective.
B. 
If a court of competent jurisdiction finds the application of any provision of this article to any lot, building or other structure or tract of land to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to the person, property or situation immediately involved in the controversy and the application of any such provision to other persons, property or situation shall not be affected.
This article shall become effective five days after final adoption by the Board of Supervisors of Caernarvon Township.
