The specific ordinances providing for participation in the Texas
Municipal Retirement System, as adopted by the city, are not included
in this chapter, but they are hereby specifically saved from repeal
and shall be maintained on file in the office of the city secretary.

(a) The
city hereby elects to join the TML Intergovernmental Employee Benefits
Pool by executing the pool’s interlocal agreement.
(b) The city hereby adopts the following benefit plans to be provided to its officers and employees through the TML Intergovernmental Employee Benefits Pool: __________. The benefit plan herein adopted is attached to Ordinance 2007-08-01 as appendix
A and incorporated herein for all purposes.

All definitions contained within this division are for the purpose
of this division only and shall have no impact on any other rule,
law or ordinance unless referenced directly within said rule, law
or ordinance.
City council
means a quorum of the mayor and aldermen of the city, acting
in a legally authorized meeting.
City council member
means the mayor or aldermen of the city acting as individual
members or in groups less than a quorum.
Department head
means any employee designated as a head of their respective
department by their supervising municipal officer.
Master policy and procedure manual
means the policy and procedure manual with an additional
attached appendix that includes all additions, deletions, amendments
and changes for the past ten (10) years and the dates of the actions.
The master policy and procedure manual shall be maintained as an official
record in the city secretary’s office.
Policy and procedure manual
means a set of documents that describe the city policies
for operation and the procedures necessary to fulfill the policies.
Policy and procedure manual committee
means a quorum of the supervising municipal officers and
department heads of the city, acting at a called meeting of the committee.
The committee shall be a leaderless group with each member having
an equal vote in all matters. All actions of the committee shall be
by a majority vote of those present.
Supervising municipal officer
means the city secretary, chief of police, and any other
municipal officer designated by the city council as supervising subordinate
city employees. This term shall not include city council members.

(a) The
city council does hereby adopt and approve the city policy and procedure
manual.
(b) The
city council does designate the city policy and procedure manual as
the primary and authoritative source of information on city policies
and procedures.
(c) The
city council recognizes the need for separate and individual policy
and procedure manuals for the departments within the city.
(d) The
city council authorizes department heads, in consultation with their
supervising municipal officer, to create and maintain departmental
policy and procedure manuals.
(e) If
a departmental policy and procedure manual is in conflict with the
city policy and procedure manual then the city policy and procedure
manual shall govern and supersede the departmental manual. A more
restrictive clause within a departmental manual shall not in and of
itself constitute a conflict.
(f) In
an approved contract is in conflict with the city policy and procedure
manual then the contract shall govern and supersede the city policy
and procedure manual.

(a) The
policy and procedure manual committee shall meet on or about the first
week of January of each year to review the city policy and procedure
manual for any needed changes, additions or deletions.
(b) The
policy and procedure manual committee shall continue to meet regularly
thereafter until such time as they have completed the review and have
presented all recommendations to the city council for action.
(c) In
addition to the annual review, the committee shall meet as set forth
within the policy and procedure manual.
(d) A
recommendation for a change in policy or procedure shall not constitute
a change in the policy and procedure manual until properly adopted
and approved by the city council.

(a) The
city council recognizes that the creation of the initial policy and
procedure manual is a monumental task and as such authorizes the policy
and procedure committee to present to the city council each part or
portion of the manual as it is completed.
(b) When
presented with a recommendation by the policy and procedure committee,
the city council may reject, change, modify, alter or replace the
policy or procedure by a majority vote of the city council prior to
the vote for acceptance of the change. In addition, the city council
may send the policy or procedure back to the committee for revision.
(c) Any
and all changes, additions and deletions to the city policy and procedure
manual shall be considered approved and adopted when passed by an
affirmative vote of the majority of the city council.
(d) Any
and all changes, additions and deletions to the city policy and procedure
manual shall not require a reconsideration of this division and shall
be made a part of this division when properly approved and adopted.
