Any person, firm or corporation violating any of the provisions of this article shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in accordance with the general penalty provided in section 1.01.009 of this code for each offense, and each and every day such offense is continued shall constitute a new and separate offense.

It shall be unlawful for any person to peddle, hawk, sell, solicit or take orders for, or offer to take orders for, any services, wares, merchandise, vehicles or goods on the streets and sidewalks, or from door to door, within the city, without first obtaining a permit from the city.

(a) 
Each application for a permit required by this article shall be in writing under oath and shall set out the following:
(1) 
Applicant name and residence;
(2) 
Name and address of the entity the person represents;
(3) 
Type of goods or services they propose to offer;
(4) 
Name and address of three references;
(5) 
Written authorization from the land owner where goods are to be displayed.
(b) 
If vehicles are to be displayed for sale, they must be parked on improved property, driveways, approved parking lots, etc.

(a) 
It shall be the duty of the chief of police, or his representative, to investigate each applicant and make a report thereon to the city secretary before the issuance of a permit.
(b) 
It shall be the duty of the city secretary to issue or refuse to issue such permit no later than one week from the time the application is received by the city secretary. A fee in the amount set forth in the fee schedule in appendix A of this code shall be charged at the time the application is filed, which shall not be prorated, and shall not be returned if the application is denied. This permit shall be good for a period of fourteen (14) days. At the end of this time period a new application fee shall be required to continue displaying goods for sale. No fee shall be required of those persons engaging in interstate commerce.
(c) 
If, after the permit required by this article has been issued, the mayor, chief of police, or city secretary finds that the permit was obtained by false representation in the application, it may be revoked by the mayor, chief of police or city secretary.

(a) 
A person merely placing pamphlets, flyers, leaflets or similar matter door-to-door only, with no contact being made with any person residing in or occupying the premises, shall not be required to obtain a permit.
(b) 
Charitable organizations or their representatives are hereby exempt from being required to obtain a permit.
