Any person who shall violate the terms and provisions of this article or aid, assist or abet in the violation of any of the terms and provisions of this article shall upon conviction be deemed guilty of a misdemeanor and shall be punished by a fine in accordance with the general penalty provided in section 1.01.009.

(a) 
It shall be unlawful for any person, firm, co-partnership or corporation to sell, offer for sale, expose for sale, use, discharge or explode any blank cartridges, toy pistol or cannon, toy cane or toy cannon in which explosives are used, firecrackers, torpedoes, skyrockets, roman candles, aerial salutes, American or Chinese bombs or other fireworks of like construction, or any fireworks containing any explosive of like construction, or any fireworks containing any explosives or inflammable compounds, or any tablets or other device commonly sold and used as fireworks containing nitrates, chlorates, oxalates, sulphides of lead, barium, antimony, arsenic, mercury, nitroglycerine, phosphorus or any compound containing any of the same or other modern explosives within the limits of the city.
(b) 
It shall be unlawful for any person, firm, co-partnership or corporation, while in the corporate limits of the city, to use or ignite by fire, combustion or friction any of the fireworks mentioned and set out in subsection (a) of this section.

(a) 
Nothing herein contained shall prohibit the use of fireworks for pyrotechnic displays given by fair associations, amusement parks, civic organizations or groups of individuals under permit granted therefor by the city secretary, nor shall the provisions of this article prohibit the use or sale of blank cartridges for theatrical purposes or for signal purposes in athletic contests or sports events, or for use by the police or military organizations, and nothing herein contained shall be construed to prohibit the use or sale of colored flares.
(b) 
Nothing in this article shall be construed to prohibit any resident wholesale dealer or jobber from selling fireworks at wholesale provided the same are shipped or delivered directly outside the limits of the city.
