The city council is hereby authorized and directed to implement the applicable provisions of this article upon its determination that such implementation is necessary to protect the public welfare and safety.

Any person, corporation or association violating these rules shall be deemed guilty of an offense, and upon conviction shall be punished by a fine in accordance with the general penalty provided in section 1.01.009 per day. The violation thereof shall be deemed a separate offense and shall be punished accordingly. Provided, however, compliance may be further sought through injunctive relief in the district court.

The provisions of this article shall apply to all persons, customers, and property served with city water, sewer, or solid waste removal services wherever situated. The rates and charges for water, sewer, and solid waste adopted in this article are effective on October 31, 2020.

(a) 
New water service.
New water service at a location where there is an existing metering device requires a deposit plus a processing fee as set forth in the fee schedule in appendix A of this code. All customers are required to sign and abide by the “water service deposit and service agreement.” New water service where there is no existing service tap shall have a minimum charge as set forth in the fee schedule in appendix A of this code. Additional costs may be incurred depending on the type or size of service requested, type of metering device, location, and proximity with the city water system. All additional costs are the responsibility of the customer. No type of maintenance, plumbing, or repairs shall be provided by the city beyond the discharge point of the metering device.
(b) 
New sewer service.
New sewer service where there is no existing sewer connection shall have a minimum charge as set forth in the fee schedule in appendix A of this code. Additional costs may be incurred depending on the type of service requested, type of connecting device, location, and proximity with the city sewer system. All additional costs are the responsibility of the customer. No type of maintenance, plumbing, or repairs shall be provided by the city beyond the inlet point of the connecting device. If a “street cut” is required, an additional charge as set forth in the fee schedule in appendix A of this code will be added to the connection service.

Multiple occupancy dwellings comprised of multiple single-family units within one common structure (units) connected with a common metering device within or without the corporate limits of the city having a connection with any mains or pipes used in connection with the city water system shall pay the rates set forth in the fee schedule in appendix A of this code.

All residents and owners of property within or without the corporate limits of the city having a connection with any mains or pipes used in connection with the city sewer system shall pay the rates set forth in appendix A per month for sewer.

All residents and owners of property within or without the corporate limits of the city having residential or commercial solid waste removal service shall pay the rates as set forth in the fee schedule.

Payment for the services listed herein shall be due from all residents and owners of property within or without the corporate limits of the city who are provided by agreement, or by contract, or by consignment any of the said services. All payments are due and payable on the first (1st) day of each month. Service periods begin and end on the tenth (10th) day of each month. A ten percent (10%) penalty will be assessed against the dollar amount of the water used if payment is not received by 9:00 a.m. on the Monday of the last full week of the month in which it is due. Water service will be disconnected.

Reconnect fees are as established in the fee schedule in appendix A of this code. Reconnections must be requested inside of regular business hours which are Monday through Friday, 8:00 a.m. to 4:30 p.m. Reconnect fees must be paid prior to reconnection and must be in the form of cash or certified funds. It is illegal for any person (including a licensed plumber) other than a city employee to reconnect water meter after city personnel has disconnected it. An additional service fee in the amount provided in appendix A of this code will be added to the reconnection fee if service is restored by any person (including a licensed plumber) other than a city employee and a citation for tampering and improper use may also be issued according to section 12.02.013.

It is illegal for any unauthorized person (including a licensed plumber) to alter, tamper with, relocate, willfully damage, or bypass a water meter. It is illegal for any person (including a licensed plumber) other than a city employee to reconnect water meter after city personnel has disconnected it. It is a violation to cover or obstruct access to a water meter. It is illegal for any person (including a licensed plumber) other than a city employee to connect plumbing to or otherwise intentionally compromise a city sewer main. It is illegal for any unauthorized person to use solid waste receptacles provided by the city.
