There is hereby created and established for the city a planning
and zoning commission.

(a) There
shall be no less than five (5) members, no more than nine (9) members
on the commission.
(b) Each
member shall be appointed by the city council and shall serve a term
of three (3) years. All vacancies shall be filled promptly after creation
of the vacancy for the unexpired term and in the same manner as provided
for original appointments.
(c) The
members of the commission shall serve without compensation.
(d) Each
member shall be a resident of the city.

The planning and zoning commission shall have the following
officers, who shall be elected by the members of the commission, shall
have a term of one (1) year, and whose respective duties are specified
as follows:
(1) Chairperson.
(A) It shall be the duty of the chairperson to preside over all meetings
of the commission and to sign all plats approved by the commission.
(B) The chairperson shall see that all actions of the commission are
properly taken.
(2) Vice chairperson.
(A) It shall be the duty of the vice chairperson to preside over commission
meetings in the absence of the chairperson; and
(B) The vice chairperson shall also perform any other duties which may
be assigned to such officer by the chairperson which are not inconsistent
with the rules and regulations set out in this city code, charter,
or other laws of the state.

The planning and zoning commission shall have the following
powers, authority and duties:
(1) It
shall exercise control over platting and subdividing land within the
corporate limits and extraterritorial jurisdiction of the city.
(2) It
shall act as an advisory board to the city council relating to public
and civic improvements.
(3) It
shall regulate zoning within the city in compliance with the laws
of the state.
(4) It shall review and recommend to the city council approval or disapproval of applications related to manufactured homes and mobile homes pursuant to article
3.04 of this code.
(5) All
property owners within three hundred (300) feet of property for which
a variance, zoning change or zoning boundary change is sought shall
be notified by regular mail of the nature of the application and the
date of the hearing before the commission at least fourteen (14) days
before the hearing.
(6) Included
in the mailed notice shall be a form whereby the property owners who
received the notice may approve or protest the matter that is the
subject of the application.
(7) The
public hearing schedule and property owner notification calendar utilized
by the city shall be based on the statutory provisions of the municipal
zoning laws of the state.
(8) The
commission shall make its recommendations to the city council regarding
each application that comes before the commission. For each such application
the commission may vote to approve, deny, or approve with conditions.

At any meeting of the planning and zoning commission, a quorum
shall consist of a majority of members then serving on the commission.
No action may be taken in the absence of a quorum, except that the
chairperson shall announce that a quorum is not present and that the
meeting will be postponed to a future date.
