A Municipal Court for the Borough is established pursuant to the provisions of N.J.S.A. 2B:12-1 et seq.

The name of the Municipal Court shall be the "Municipal Court of the Borough of Lakehurst, in the County of Ocean."

The Municipal Court shall have a seal which shall bear the impress of the name of the Court.

There shall be a Judge of the Municipal Court, who shall be appointed by the Governing Body, and who shall serve for a term of three (3) years from the date of his appointment and until his successor is appointed and qualified.

The Judge of the Municipal Court shall receive an annual salary to be paid in the same manner as the salaries of other Borough officers are paid, and shall be in lieu of all fees, costs, and other allowances whatever.

The Municipal Court and the Judge of the Municipal Court thereof shall have, possess and exercise all the functions, powers, duties and jurisdiction by the provisions of N.J.S.A. 2B:12-1 et seq.

There shall be a Court Administrator, who shall be responsible for the daily management of the Municipal Court. He shall perform such functions and duties as shall be prescribed for him by law, the rules applicable to municipal courts, and by the Judge of the Municipal Court.

The Municipal Court shall be held at the Manchester Municipal Court, the calendar shall be set by the Judge of the Municipal Court.

Creation of Position. There is hereby created the position of Deputy Court Administrator.
b.
Duties. The Deputy Court Administrator shall perform the duties of the Court Administrator in the absence or disability of the Court Administrator. At all other times the Deputy Court Administrator shall act as the assistant to the Court Administrator and be under the control and charge of the Court Administrator and shall perform such other duties and functions as are required by this Office or the Statutes.

The Governing Body, pursuant to the provisions of N.J.S.A. 2A:158A-1 et seq., shall require that any person applying for representation by a Municipal Public Defender shall pay an application fee of two hundred ($200.00) dollars; or as set by resolution consistent with applicable standards. The Municipal Court may waive the required application fee, in whole or in part, if the Court determines, in its discretion that the application fee represents an unreasonable burden on the person seeking representation.

There is hereby established the office of Public Defender of the Borough of Lakehurst for the defense of indigent defendants entitled by law to the appointment of counsel, pursuant to the terms of N.J.S.A. 2B:24-3, for offenses cognizable by the Municipal Court of the Borough of Lakehurst.

The Public Defender shall be appointed by the Governing Body, for the period of one (1) year.

The Public Defender shall be an attorney-at-law of New Jersey in good standing, and have a minimum of two (2) years experience in criminal defense work.

The Public Defender shall interview all indigent defendants qualifying for assistance and defend same in the Municipal Court in the Borough only, and not in any other court.

The Municipal Court Judge may direct the Public Defender to defend indigents in matters other than those designated in N.J.S.A. 2B:24 et seq. upon his finding that the nature of the penalty, if convicted, would represent a consequence of magnitude for the defendant if not afforded the representation of counsel.

There shall be established the position of Municipal Prosecutor of the Borough.

The Municipal Prosecutor shall be appointed by the Governing Body, for a one (1) year term, or part thereof, terminating on December 31 of each calendar year, or until reappointed or replaced. He shall be an attorney-at-law admitted to practice in the State of New Jersey, and shall be a member in good standing of the Bar of the State of New Jersey.

The Municipal Prosecutor shall receive such compensation as may be fixed by the Governing Body.

The powers, duties and responsibilities of the Municipal Prosecutor shall be to conduct prosecutions for crimes and offenses cognizable by the Municipal Court of the Borough including violations of ordinances of the Borough, violations of the drug laws and regulations, preliminary hearings on criminal complaints, and such other matters when so directed by the Governing Body. The Municipal Prosecutor shall have the duties as established by N.J.S.A. 2B:25-5. The Municipal Prosecutor shall attend such sessions of the Municipal Court as directed by the Governing Body.

All papers, documents, memorandum, and other materials relating to prosecution or to the duties of a Municipal Prosecutor shall be and shall remain the property of the Borough.
