(a) 
In accordance with Texas Local Government Code sec. 284.108, this division is to provide a design manual that includes additional installation and construction details which do not conflict with chapter 284. To the extent of any conflict with this article, division 2, this wireless services design manual shall control with regard to a provider.
(b) 
The town encourages the deployment of state-of-the-art small cell wireless technology within the town for the many benefits it promises the citizens of the town including increased connectivity and reliable networks and services.
(c) 
The standards and procedures provided in this wireless services design manual are adopted to protect the health, safety, and welfare of the public by minimizing and reducing impacts to public safety within the town’s right-of-way and to minimize and reduce impacts to the town, its residents and visitors; and for the general health and welfare of the public.
(d) 
Due to the increasing number of facilities in the town’s right-of-way, the town has amended chapter 13 utilities to include article 13.08, “right-of-way management,” which is applicable to all public service providers including wireless service providers or network providers (collectively, “providers”) as defined by chapter 284 of the Texas Local Government Code.
(e) 
In addition, the town has adopted this wireless services design manual to provide technical criteria and details necessary for providers seeking to install and construct network nodes and node support poles in the town’s right-of-way.
(f) 
Providers shall adhere to the requirements found in article 13.08, “right-of-way management” of chapter 13 “utilities” and this wireless services design manual for the placement of their facilities within the town’s right-of-way.
