(a) Pursuant
to the provisions of section 22.071 of the Local Government Code,
the city council does hereby designate the office of police chief
as an officer of the municipality, with such office to have such powers
and duties as are commonly specified for such officers in state law
or as more specifically provided for under city ordinance.
(b) A
person in such position can only be removed pursuant to the provisions
of section 22.077 of the Local Government Code of the state, or its
successor legislation.

The chief of police shall have such powers and duties as are
commonly specified for such officers in state law or as more specifically
provided for under city ordinance. The chief of police shall carry
out the functions of the police department relating to public safety
and enforcement of ordinances, state and federal laws; organize the
police department of the city in conformity with the laws of the state
and ordinances of the city; and shall promulgate policies, procedures,
rules, directives and orders for the administration of the department,
including but not limited to discipline within the department.

The chief of police shall not be employed by or affiliated with
any business or organization doing business with the city and shall
hold no office with any other governmental unit. This section shall
not be interpreted to prevent the chief of police from holding offices
in civic organizations, with city council approval.
