In this division:
Mobile food vendor.
An individual, including an employee or agent of a group
of individuals, partnership, or corporation, who sells or offers to
sell food or beverages, on any public way from a vending vehicle.
Public way.
All areas legally open to public travel, including, but not
limited to streets, sidewalks, roadways, highways, parkways, and alleys,
but not including parks.
Vending vehicle.
A motor vehicle used for the operation of the business of
peddling of ice cream, frozen desserts, or other edible product, intended
for use as food or drink for human consumption.

(a) The
city shall not issue a permit to a mobile food vendor for the purpose
of authorizing the sale of ice cream, frozen desserts, or other edible
products intended for use as food or drink for human consumption from
a vending vehicle in any public way.
(b) A
person commits an offense if the person operates a vending vehicle
and sells ice cream, frozen desserts, or other edible products intended
for use as food for human consumption on a public way in the city.
