There is adopted by the city, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the International Fire Code, 2018 edition, the code being adopted in its entirety, of which code not less than three copies have been and now are filed in the office of the city secretary, and the same are adopted and incorporated to the same extent as if set out in full at this point herein.

For the purpose of this article, the following definition shall apply, unless the context clearly indicates or requires a different meaning:
Municipality.
Whenever used in the fire prevention code adopted by this article, the City of Kermit.

The fire prevention code adopted by this article shall be enforced by the fire official, the same being the fire marshal. The fire marshal shall enforce the provisions of this code and all state laws under his or her jurisdiction pertaining to the prevention, suppression, or extinguishing of fires. The fire marshal shall have the power to cause the arrest of any person violating any of the provisions of this code by a duly commissioned peace officer.

The fire marshal shall have the power to waive any of the provisions of the fire prevention code adopted by this article upon application in writing by the owner or lessee, or his or her duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the fire prevention code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such waivers when granted or allowed, and the decision of the fire marshal thereon, shall be entered upon the records of the department, and a signed copy shall be furnished the applicant.

Whenever the fire marshal shall disapprove an application or refuse to grant a permit applied for, or when it is claimed the provisions of the fire prevention code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the fire marshal to the city council within 30 days from the date of the decision appealed.

(a) 
Any person who shall violate any provisions of the fire prevention code adopted in section 6.02.001 or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the fire marshal or by a court of competent jurisdiction, within the time fixed therein, shall severally, for each such violation or noncompliance respectively, be punishable as provided in section 1.01.009.
(b) 
The imposition of such penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violation or defects within a reasonable time. When not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense.
(c) 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
