(a) Hazardous material. Light truck. Pole trailer. Semi-trailer. Trailer. Truck. Truck tractor. Vehicle.
Definitions.
For the purpose of this section, the following definitions shall apply, unless the context indicates or requires a different meaning:
Includes but is not limited to any material which is explosive, flammable, and/or toxic.
Means any truck with a manufacturer’s rated carrying capacity not to exceed 2,000 pounds and is intended to include those trucks commonly known as pickup trucks, panel delivery trucks and carry-all trucks.
Every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole, or by being boomed or otherwise secured to the towing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes, or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
Every vehicle, with or without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
Every vehicle, with or without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
Every motor vehicle designed, used, or maintained primarily for the transportation of property.
Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon stationary rails or tracks.
(b)
Routes designated.
No person shall operate a vehicle transporting hazardous materials or operate a truck, truck tractor, trailer, semi-trailer, or pole trailer in excess of a rated weight of two tons on any street, roadway or highway within the city except upon the following portions of the following streets or roadways, which are hereby designated as “truck routes”:
(1)
Traffic traveling south on State Highway 18 shall turn east on truck route, County Road 313 to State Highway 302, traveling west on State Highway 302 to the intersection of State Highway 302 and State Highway 18 and turn south on State Highway 18.
(2)
Traffic traveling north on State Highway 18 shall turn east on State Highway 302, traveling to truck route, County Road 313 and turning north, following route to junction of State Highway 18 and turning north on State Highway 18.
(3)
Traffic traveling west on State Highway 115 shall turn north on truck route, County Road 313, continue across State Highway 18 on truck route, County Road 133, and returning to State Highway 115 and turning south on State Highway 115.
(4)
Traffic traveling east on State Highway 115 shall turn north on truck route, County Road 133, continue across State Highway 18 on County Road 313, and returning to State Highway 115 and turning east on State Highway 115.
(c)
Exceptions.
This section shall not apply to:
(1)
Traffic originating from the city, or entering the city for the purpose of deliveries, services, repairs, and stops pursuant to the business of the owner of the vehicle entering the city or leaving the city for the aforesaid purposes. Such vehicles shall follow the most direct route which is consistent with a reasonable operation of the vehicle; and
(2)
Emergency vehicles or vehicles in the service or maintenance departments of the city, the county, the state department of transportation or public utilities.
(d)
Departure from truck routes.
(1)
Generally.
Trucks, truck tractors, trailers, semi-trailers, and pole trailers restricted to the streets designated as “truck routes” herein may depart from such truck routes in accordance with subsection (c) above; provided, however, such vehicles shall follow the most direct truck route to the point nearest their ultimate destination, and provided further that such vehicles shall not leave designated truck routes until they have reached a turning off point that can be described as the shortest distance practical to the ultimate destination of the vehicle, which is consistent with a reasonable operation of the vehicle.
(2)
Evidence of origin or destination required.
Any person operating any of the aforesaid vehicles upon any street or roadway which is not designated a truck route as provided for hereinabove shall have in his possession for the inspection of police officers his log book, or other evidence of his destination and point of origin, to justify the presence of said vehicle on a street or roadway other than a designated truck route. Failure to have such a log book or other evidence in his possession shall not be an offense, but shall create a presumption that such person is unlawfully operating one of the aforesaid vehicles upon a street or roadway which is not designated a truck route.
(e)
Signage.
The city manager shall cause to be erected appropriate signs and markings advising operators of the above-named vehicles of the truck routes established herein. Whenever any street or roadway designated as a truck route is under repair or otherwise temporarily out of use, the city manager shall be authorized to designate alternate truck routes.
