For the purpose of this article, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
Bags.
Plastic sacks designed to store refuse with sufficient wall strength to maintain physical integrity when lifted by the top. Total weight of a bag and its contents shall not exceed 35 pounds.
Bin.
A metal receptacle designed to be lifted and emptied mechanically for use at residential, commercial and industrial units for the special collection service of bulky waste and construction debris, as defined herein.
Building.
Any structure that encloses a space used for sheltering any occupancy. Each portion of a building separated from the other portions by an impervious wall shall be considered a separate building or structure unit.
Bulky waste.
Stoves, refrigerators, water tanks, washing machines, furniture, and other waste materials other than construction debris, dead animals, hazardous waste or stable matter with weights or volumes greater than those allowed for containers, as the case may be.
Bundle.
Tree, shrub and brush trimmings or newspapers and magazines securely tied together forming an easily handled package not exceeding five feet in length or 50 pounds in weight.
Commercial and industrial refuse.
All bulky waste, construction debris, garbage, rubbish and stable matter generated by a producer at a commercial and industrial unit.
Commercial and industrial unit.
All premises, locations or entities, public or private, requiring refuse collection.
Commercial debris.
Waste building materials resulting from construction, remodeling, repair or demotion operations with weights or volumes greater than those allowed for containers, as the case may be.
Construction and demolition.
Remains from destruction of a building or other structure.
Disposal site.
A refuse depository within a geographical proximity from the city, including but not limited to sanitary landfills, transfer stations, incinerators, and waste processing/separation centers, licensed, permitted or approved by all governmental bodies and agencies having jurisdiction and requiring such licenses, permits or approvals to receive for processing or final disposal of refuse and dead animals.
Extraterritorial jurisdiction.
The unincorporated area that is contiguous to the corporate boundaries of the city and that is located within one mile of those boundaries.
Garbage.
Any and all dead animals of less than ten pounds in weight, except those slaughtered for human consumption; every accumulation of waste (animal, vegetable and/or other matter) that results from the preparation, processing, consumption, dealing in, handling, packing, canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, grains or other animal or vegetable matter (including, but not by way of limitation, used tin cans and other food containers; and all putrescible or easily decomposable waste animal or vegetable matter which is likely to attract flies or rodents); except (in all cases) any matter included in the definition of bulky waste, construction debris, dead animals, hazardous waste, rubbish or stable matter.
Hazardous waste.
Waste, in any amount, which is defined, characterized or designated as hazardous by the United States Environmental Protection Agency or appropriate state agency by or pursuant to federal or state law, or waste, in any amount, which is regulated under federal or state law. For purposes of this article, the term “hazardous waste” shall also include motor oil, gasoline and paint.
Liquid waste.
Fluids [such] as wastewater, fats, oils or grease (FOG), used oil, and hazardous household liquids.
Permanent.
A period of time over 45 days.
Producer.
An occupant of a commercial and industrial unit or a residential unit who generates refuse.
Receptacle.
A container intended for the collection of garbage, constructed of plastic, metal or fiberglass, having adequate strength for lifting; shall be liquid-tight and have a lid capable of discouraging the entrance of vectors and small animals. The weight of a container and its contents shall not exceed the lifting capability of the collection vehicle.
Recyclable materials.
Any solid waste or material having a market value for recovery.
Refuse.
Residential refuse, commercial and industrial refuse, bulky waste, construction debris, and stable matter generated at a residential unit, unless the context otherwise requires, and commercial and industrial refuse.
Residential refuse.
All garbage and rubbish generated by a producer at a residential unit.
Residential unit or dwelling unit.
A dwelling occupied by a person or group of persons comprising not more than four families. A residential unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto. A condominium dwelling, whether of single- or multi-level construction, consisting of four or less contiguous or separate single-family dwelling units, shall be treated as a residential unit, except that each single-family dwelling within any such residential unit shall be billed separately as a residential unit.
Roll-off.
An open-top container characterized by a rectangular footprint, utilizing wheels to facilitate rolling the dumpster in place. The open-top container is designed to be transported by special roll-off trucks. Roll-offs are commonly used to contain loads of construction and demolition waste or other waste types.
Rubbish.
All waste wood, wood products, tree trimmings, grass cuttings, dead plants, weeds, leaves, dead trees or branches thereof, chips, shavings, sawdust, printed matter, paper, pasteboard, rags, straw, used and discarded mattresses, used and discarded clothing, used and discarded shoes and boots, combustible waste pulp and other products such as are used for packaging or wrapping crockery and glass, ashes, cinders, floor sweepings, glass, mineral or metallic substances, and any and all other waste materials not included in the definition of bulky waste, construction debris, dead animals, garbage, hazardous waste or stable matter.
RV park.
Any facility designed to accommodate more than one movable housing unit which provides permanent or temporary living quarters, including but not limited to mobile homes, travel trailers and recreational vehicles.
Stable matter.
All manure and other waste matter normally accumulated in or about a stable, or any animal, livestock or poultry enclosure, and resulting from the keeping of animals, poultry or livestock.
Structure unit.
Any room or enclosed or demarcated area, or group or combination thereof, located within a building and occupied by a business or family other than the business or family occupying other parts of the building.
Tonnage/tipping fee.
The charge levied upon a given quantity of waste received at a waste processing facility.
Transient.
A period of time 45 days or less.

Any person, firm, or corporation who violates any provision of this article shall, upon conviction, be subject to a fine not exceeding $500.00 for each separate violation. However, a fine or penalty for the violation of a rule, ordinance, or police regulation that governs fire safety, zoning, or public health and sanitation, including dumping of refuse, may not exceed $2,000.00. Each day of any continuing violation shall constitute a separate offense.

Every owner, occupant, tenant, manager, operator or lessee using or occupying any building, house or structure within the city limits for residences, churches, schools, lodges or commercial, industrial, business or any other purposes, upon their request, shall be provided with a receptacle or receptacles (owned and maintained by the city) to sufficiently hold the garbage and acceptable rubbish that will normally accumulate on the premises.

It shall be the duty of every person owning, managing, operating, leasing or renting any premises or any place where garbage or rubbish accumulates, to deposit all acceptable waste, as defined in section 12.02.005, in the receptacles and to remove at their own expense any unacceptable waste, as so defined, to an approved disposal site.

(a) 
Accepted waste to be placed in receptacles.
All garbage, as so defined, and rubbish consisting of printed matter, paper, pasteboard, rags, straw, used and discarded clothing, used and discarded shoes and boots, combustible waste pulp and other products such as are used for packaging or wrapping crockery and glass, ashes, cinders, floor sweepings, glass, and mineral or metallic substances shall be the only accepted waste disposed of in receptacles and collected as a sanitation service provided by the city.
(b) 
Bulky waste from residences.
All residential refuse specifically, but not limited to, tree trimmings, branches, grass cuttings, weeds, leaves and other yard materials, shall be placed in bags or bundles and collected separate from garbage and other rubbish as a sanitation service provided by the city. Bags, bundles and bulky waste, as so defined, for residential collection shall not be placed in receptacles, however, shall be placed upon public right-of-way and shall be placed as close to the roadway as practicable (curb pickup) without interfering with or endangering the movement of vehicles or pedestrians. The customer/resident must call city hall for scheduling collection of bulk items. When construction work is being performed in the right-of-way, bags, bundles, and bulky waste shall be placed as close as practicable to an access point for the collection vehicle.
(c) 
Bulky waste from commercial and industrial units; construction debris.
Bulky waste from commercial and industrial units and construction debris will not be collected as a regular sanitation service. The city shall provide bin collection service for the collection of bulky waste, construction debris, and other rubbish, or any refuse not permitted in receptacles or collected as a regular sanitation service from residential, commercial and industrial units. Such service shall be upon request and according to individual agreement between the customer and the city corresponding to the roll-off rate schedule.

It shall be the duty of any person employing, engaging or otherwise paying a contractor, student, professional tree trimmer or any other person to trim and prune his or her trees or shrubs to have the trimmings and debris removed at the owner’s expense. The city will not collect such debris as regular service.

Dead animals shall not be placed in receptacles. The city humane officer will, upon notice to do so, collect and remove dead animals such as dogs, cats and other small house pets.

Every owner, occupant, firm, corporation, or agent of residential, commercial, or vacant property whose responsibility is to clean and remove from the premises such items as weeds, dead trees, or brush, or any rank or uncultivated growth of vegetation which exceeds 12 inches in height and engulfing an area that any prudent citizen would recognize as a health hazard, fire hazard, or nuisance [shall be responsible to dispose of such items]. In addition to the premises of residential, commercial, or vacant property within their respective boundaries, the area of responsibility shall include the area extending beyond the property line to the center of adjacent alleys, streets, public easements, or rights-of-way [and the responsible person] shall dispose of such items at the citizens collection station or use the curb pickup program to dispose of such items.

It shall be unlawful for any owner, occupant, tenant or lessee using or occupying a building, house, or structure as a separate unit to maintain their personal receptacles and trash containers in alleys, along property lines, or in city rights-of-way. The receptacles, garbage containers and metal or wooden receptacle racks shall be removed from all alleys, property lines, or city rights-of-way.

No person shall allow garbage or rubbish or any other debris to accumulate on his or her premises. All temporarily stored garbage and rubbish shall be kept in receptacles or placed in bags or bundles and shall not be allowed or permitted to be blown or scattered off the premises.

The placing of garbage or rubbish outside of any receptacle is hereby prohibited. Bulky waste and yard waste such as tree trimmings, branches, grass cuttings, weeds, leaves and other yard materials so placed in bags or bundles shall be taken to the citizens collection station by the resident/customer or may be placed on the front curb and must be called into the city for scheduling pickup.

It shall be unlawful for any person to sweep, place, push, throw, or deposit any garbage, rubbish, construction debris, yard waste, hazardous waste, liquid waste, dead animals, or any debris into, upon or along any drain, gutter, alley, sidewalk, parkway, street, or vacant lot, or upon any public or private premises within the city, with the exception of the curb pickup program.

The burning of garbage, rubbish or any other debris within the city limits is prohibited.

The relocating, damaging, defacing or meddling of any receptacle is prohibited. The meddling with garbage, rubbish or any debris, or in any way pilfering, scattering contents or any attempt to salvage materials so placed in receptacles or in any alley or public right-of-way within the city is prohibited.

The collection, removal and disposal of all garbage and rubbish from receptacles shall be made twice a week from all residential, commercial, and industrial units, as weather conditions and other uncontrollable factors will permit. The collection, removal and disposal of all residential refuse specifically, but not limited to, tree trimmings, branches, grass cuttings, weeds, leaves and other yard materials, so placed in bags or bundles, and bulky waste, shall be made from residential units through the curb pickup program and must be called in to the city for scheduling, as weather conditions and other uncontrollable factors will permit. Collection, removal and disposal services shall be made daily, Monday through Friday, and shall be performed in a systematic and efficient manner, maintaining a clean and sanitary environment.

In addition to the usual enforcement agencies of the city, it is hereby made the duty of the city sanitation supervisor or his or her authorized representatives to make inspection trips at regular intervals to determine whether or not garbage, rubbish and other debris is being properly collected, removed and disposed of as required by the provisions of this article or any other applicable sanitation ordinance. In the event it is found that this article or any other applicable sanitation ordinance is being violated, appropriate and timely action shall be taken to insure full compliance with its provisions.

The city or its designated agent shall operate a regular garbage collection service as defined herein. This service shall include the collection of garbage (as defined by this article) provided that such garbage is properly placed in a container. All other refuse shall be deemed as a special pickup which shall be picked up by the city upon request by the customer through the curb pickup program or may be taken by the citizen to the citizens collection station.

The city or its designated agent shall operate a special pickup service as defined herein. This service shall be made available on an as-requested basis to all customers who shall request such service. Special pickup fees shall be billed separately from the regular garbage collection fees and shall be applicable in all cases involving a request for pickup which does not qualify as being a part of the regular garbage collection service.

It shall be unlawful for any person to transport any liquid or solid material along any city street, alley, easement or public property or along any state or county highway, road or easement within the city without first securing and fastening down any material to prevent the loss or spillage of such materials. In the event any such material becomes loose or scattered it shall be the responsibility of the operator of the vehicle to remove and properly dispose of and to assume the expense of repairing any damages to such public property, including expense of such removal and disposal.

It shall be unlawful for the driver of any truck being operated within the city limits to allow loads of waste to be blown from or to fall from the truck/trailer.
