ARTICLE 13.02 ELECTRIC UTILITIES

§ 13.02.001 PUC to exercise jurisdiction over electric utilities.

The city does hereby elect to have the state public utility commission exercise exclusive original jurisdiction over electric utility rates, operations, and services within the existing and future incorporated limits of the city.

§ 13.02.002 City to retain jurisdiction over water and sewer utilities.

The city hereby expressly retains the exclusive original jurisdiction over the rates, operations, and services of water and sewer utilities within the existing and future incorporated limits of the city.

§ 13.02.003 Effective date of PUC jurisdiction.

This article shall become effective, and the state public utility commission shall exercise the exclusive original jurisdiction over said electric utility rates, operations, and services on and after August 4, 1980.

§ 13.02.004 Notice to PUC.

The city secretary shall give notice of this article to the state public utility commission by forwarding a certified copy of same to the state public utility commission upon the passage of this article.
