Upon presentation of proper credentials, the Township and its duly authorized representatives may enter at reasonable times upon any property within the Township to inspect the condition of the stormwater structures and facilities in regard to any aspect regulated by this chapter.
A. 
The Municipal Engineer or his designee shall observe any phases of the installation of the permanent stormwater management facilities that are deemed appropriate by the Township.
B. 
During any stage of the work, if the Township determines that the permanent stormwater management facilities are not being installed in accordance with the approved stormwater management plan, the Township will revoke any existing land use permits until a revised drainage plan is submitted and approved, as specified in this chapter.
The governing body of the Township is hereby authorized and directed to enforce all of the provisions of this chapter. All inspections regarding compliance with the SWM site plan shall be conducted by the Municipal Engineer or other qualified persons designated by the Township.
A. 
The SWM site plan approved by the Township shall be on file at the project site throughout the duration of the construction activity. Periodic inspections may be made by the Township or its designee during construction.
B. 
It shall be unlawful to undertake any regulated activity except as provided for in the approved SWM site plan and pursuant to the requirements of this chapter. It shall be unlawful to alter or remove any control structure required by the approved SWM site plan pursuant to this chapter or to allow the property to remain in a condition which does not conform to the approved SWM site plan.
C. 
At the completion of the project, and as a prerequisite for the release of the performance guarantee, the owner or his representative shall:
(1) 
Provide a certification of completion from a qualified professional verifying that all permanent facilities have been constructed according to the plans and specifications and approved revisions thereto.
(2) 
Provide a set of record drawings.
D. 
Upon receipt of a certification of completion and record drawings, the Township shall direct the Municipal Engineer to conduct a final inspection.
E. 
Suspension and revocation of approvals and/or permits.
(1) 
Prior to revocation or suspension of an approval or permit, the governing body of the Township shall schedule a hearing to discuss the noncompliance if there is no immediate danger to life, public health or property.
(2) 
Any approval or permit issued by the Township may be suspended or revoked by the governing body of the Township for:
(a) 
Noncompliance with or failure to implement any provision of the approval or permit.
(b) 
A violation of any provision of this chapter or any other applicable law, ordinance, rule or regulation relating to the project.
(c) 
The creation of any condition or the commission of any act during construction or development which constitutes or creates a hazard or nuisance, pollution or which endangers the life or property of others.
(3) 
A suspended approval or permit shall be reinstated by the governing body of the Township when:
(a) 
The Township Engineer or his designee has inspected and approved the corrections to the stormwater management and erosion and sedimentation pollution control measure(s), or the elimination of the hazard or nuisance; and/or
(b) 
The governing body of the Township is satisfied that the violation of the ordinance, law or rule and regulation has been corrected.
(c) 
An approval or permit that has been revoked by the governing body of the Township shall not be reinstated. The applicant may apply for a new permit under the procedures outlined in this chapter.
A. 
Any person violating any provision of this chapter shall, upon conviction thereof in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be sentenced to pay a fine of not more than $1,000 for each violation plus costs of prosecution, including but not limited to reasonable attorneys' fees, or, upon default of payment of fines, costs and/or restitution, by imprisonment for a period not to exceed 30 days. Each day upon which a violation exists shall constitute a new and separate violation of this chapter.

B. 
In addition, the Township may institute injunctive, mandamus or any other appropriate action or proceeding at law or in equity for the enforcement of this chapter. Any court of competent jurisdiction shall have the right to issue restraining orders, temporary or permanent injunctions, mandamus or other appropriate forms of remedy or relief.
A. 
Any person aggrieved by any action of the Township or its designee relevant to the provisions of this chapter may appeal to the Township within 30 days of that action.
B. 
Any person aggrieved by any decision of the Township, relevant to the above appeal of this chapter, may appeal to the Cumberland County Court of Common Pleas within 30 days of the Township's decision.
