(a) 
The fire marshal, building official, electrical inspector, police officers, and such other persons designated by the city shall have the power and it shall be their duty to examine and inspect from time to time all telephone poles, gas pipelines, pipes and other fixtures in the public places within the city for the purpose of seeing that all of same are in a safe and suitable condition.
(b) 
Whenever any such item is found to be unsafe or unsuitable for the purpose for which it is used, the person using, possessing or maintaining the item shall be notified and required to place same in a safe and suitable condition.

(a) 
The request for purchasing city-owned streets or public ways shall be in writing and should have the following information listed.
(1) 
Name of person making request to purchase city-owned streets or public ways.
(2) 
Description of the street or public way that the person would like to purchase. A nonrefundable administration fee, as set out below shall be paid.
(b) 
The request then goes before city council for approval or disapproved to sell.
(c) 
If the city council agrees to sell city-owned street or public way, the following criteria is required and is to be paid by the potential buyer.
(1) 
The property to be sold is required to be surveyed by a certified surveyor.
(2) 
The property to be sold is required to be appraised by a certified appraiser.
(d) 
Because the city is allowing the city street or public way to be sold, the city will send a letter to all property owners that have property abutting the city-owned street or public way that is to be sold. This will give any abutting property owner the same right to purchase the city-owned street or public way. All abutting property owners who choose to purchase a portion of said property shall pay a pro-rata share of the survey and appraisal expenses. The property shall be sold for an amount equal to or greater than the appraised amount. All property owners who choose to purchase a portion of said property shall be required to pay the administration fee as set out below in full.

Upon the filing of such request with the city secretary, a nonrefundable administration fee in the amount as provided in appendix A to this code shall be deposited with the city secretary to cover the expense of administering the procedure outlined in this section and the cost of mailing notices.

City council in its sole discretion may choose to abandon, alter, close or vacate any public way. Prior to taking any action the city shall publish notice in the newspaper that states the council’s intention to consider closing, abandoning, altering or vacating a public way and shall hold a public hearing regarding the same. After such notice and public hearing, council, at a posted open meeting, shall have sole discretion regarding what action to take regarding public ways. Any closure of a public way shall be done via city ordinance.
