Administrative enforcement of the terms of this article shall be by the city manager. It shall be the duty of the city manager to enforce the provisions of this article, and to that end he is vested with police authority.

In addition to any other penalty provided by this article, the council may direct the city attorney to initiate an action in any court having competent jurisdiction to enjoin any violations of the provisions of this article or for an injunction to compel compliance with any provisions of this article.

This article is intended to supersede and displace the previous existing ordinances, but all conditions in violation of the previous ordinances shall nevertheless be punishable under this article. All permits issued under the previous ordinances shall continue valid unless and until the permittee shall have violated the terms of the permit or the terms of this article. All certificates of insurance posted under the previous ordinances shall remain applicable for the same purpose for which they were required.

This article or any part thereof may be altered, repealed or amended at any time, and no rights or privileges may ever be acquired hereby which may not be altered, repealed or modified by the city.

Any and all provisions of this article, except for section 4.05.101, may be waived by the city upon a showing by the applicant to the satisfaction of the city council that the planned manner of operation by the applicant or the equipment to be used by the applicant will adequately protect the environment, public health, safety and welfare.
