The above recitals and legislative findings are found to be
true and correct and are hereby incorporated herein and made a part
hereof, as if fully set forth in their entirety.[1]

As used in this Part 9A, the following terms shall have the
meanings indicated:
The standing of a vehicle, whether occupied or not, otherwise
than when temporarily and actually engaged in loading or unloading
of merchandise, property, or passengers, and except when necessary
to avoid conflict with other traffic, or in compliance with the directions
of a police officer or traffic control signal or device.
The Village Manager is authorized to approve the dates, times,
and locations for implementation of temporary no-parking restrictions.
The Village Manager is authorized to implement the temporary
no-parking restrictions in the designated locations where vehicles
shall not be permitted to park.
The Village Manager shall identify the locations of the temporary
parking zones by directing the placement of appropriate signs in the
areas where parking is to be prohibited, informing the public that
parking in the designated area is prohibited and that violators are
subject to a fine and having their vehicle towed at the owner's expense.
The Village Manager shall select an authorized designee to act
in his or her place, in the event of the Village Manager's absence
or inability to act, in order to implement temporary no parking restrictions
in accordance with this Part 9A.
The Department of Public Works shall assist in the placement
and removal of the signs and barricades in the locations designated
by the Village Manager.
The owner or operator of any vehicle violating or failing to
comply with the provisions of this Part 9A as they pertain to and
concern restrictions on parking shall, upon a finding of liability,
be fined not less than $125 and no more than $250 for each offense.
A ticket noting a violation of this Part 9A may be issued by
a Village Code Enforcement Officer or a Deputy Sheriff employed as
a law enforcement officer by the Office of the Will County Sheriff.
Any vehicle in violation of the temporary parking restrictions
is also subject to being towed at the owner's expense.
Any violation of the temporary parking restrictions implemented
pursuant to this Part 9A shall be subject to administrative adjudication
in the Village of Homer Glen.
If any section, paragraph, clause, or provision of this Part
9A shall be held invalid, the invalidity thereof shall not affect
the other provisions of this Part 9A.
All ordinances, resolutions, motions, or orders in conflict
with this Part 9A are hereby repealed to the extent of such conflict.
This Part 9A shall be in full force and effect immediately upon
its passage due to the urgency of this matter as found by the Village
Board pursuant to 65 ILCS 5/1-2-4 and as otherwise provided by law.
