An auxiliary police force to be known as the Forney Police Reserve is hereby established. The police reserve force shall be separate and distinct from the city police department. The members of the police reserve force shall serve on a voluntary basis.

(a) 
The chief of police shall be the head of the police reserve force and the members thereof shall be under his authority, control and command, subject to this division and other ordinances of the city and laws of the state and of the United States.
(b) 
The chief of police may by order establish rules and regulations to govern the police reserve force, to fix specific duties of its members and to provide for the maintenance of discipline. He may change such orders from time to time and may command members of the police reserve force to obey the instructions of regular police officers in carrying out their orders.

The police reserve force shall be composed of personnel who have volunteered to join the organization and whose applications for membership have been approved and who have complied with all the rules, regulations and orders provided for the conduct and control of the members thereof. The city council may from time to time limit the size of the police reserve force by appropriate resolution. The city council shall by resolution establish authorized staffing levels and rank structures within the police reserve force based upon recommendations submitted by the chief of police. All commissions shall expire automatically at midnight on the 31st day of December any year. A renewal of said commission for any next ensuing year may be had by filing an application for same. Said application shall consist of a postcard properly filled out by the applicant, giving his full name and address and the number of his existing commission. This application shall be filed with the chief of police. If application for renewal is not presented on or before January 31st of the year for which renewal is sought, then anyone desiring a commission as a member of the police reserve force shall make application as in the first instance where an applicant did not hold a commission.

The police reserve force shall act only in a supplementary capacity to the regular police force and shall in no case assume the full-time duties of regular police officers without first complying with all requirements for such regular police officers. Members of the police reserve force shall not be used to perform any duty normally performed by a regular officer unless there is no regular officer available to perform the task and the nature of the task requires immediate performance. Members of the police reserve force serve at the discretion of the chief of police and may be called into service at any time the chief of police considers it necessary to have additional officers to preserve the peace and enforce the law.

An applicant for membership in the police reserve force shall meet the minimum standards for appointment as promulgated by the state commission on law enforcement officer standards and education, to include the following, to wit:
(1) 
Be a citizen of the United States;
(2) 
Be at least twenty-one (21) years of age;
(3) 
Meet the same residency requirements as may be in effect for full-time employees;
(4) 
Be fingerprinted and have had a search made of local, state and national fingerprint files to disclose any criminal record;
(5) 
Not have been convicted by any state or federal court of “driving while intoxicated” or “driving under the influence of drugs” within the last ten (10) years, nor ever convicted of a felony under the laws of the State of Texas, another state or the United States;
(6) 
Be of good moral character as determined by a thorough background investigation;
(7) 
Be a high school graduate or have a graduate equivalency diploma (GED);
(8) 
Be examined by a licensed physician and meet those physical requirements as prescribed by the state commission on law enforcement officer standards and education;
(9) 
Be examined by a licensed physician, psychiatrist or clinical psychologist to determine that the applicant has the necessary emotional stability to perform police duties, and meet the minimum mental qualifications as set forth by the state commission on law enforcement officer standards and education;
(10) 
If applicable, have been discharged from military service under honorable conditions;
(11) 
Pass any written examination(s) administered by the police department; and
(12) 
Satisfactorily complete the prescribed basic course for reserve police officers as prescribed by the state commission on law enforcement officer standards and education.

No person appointed to the police reserve force may carry a weapon or otherwise act as a peace officer until:
(1) 
Satisfactorily completed the reserve officer’s basic training course in an academy certified by the state commission on law enforcement officer standards and education; and
(2) 
Approved by the city council.
After meeting conditions (1) and (2) above, the reserve officer may carry a weapon only when authorized by the chief of police and when discharging official duties as a duly constituted peace officer.

(a) 
Powers as peace officer.
Police reserve officers shall have full powers as peace officers only when called to active duty and engaged in the actual discharge of their official duties.
(b) 
Entering private property.
No member of the police reserve force shall break into or otherwise forcefully enter upon private property or enter the dwelling or habitation of another person without the consent of the member of the police department of this city who then and there requests aid in the enforcement of the law.
(c) 
Powers of arrest.
A member of the police reserve force shall have the following powers of arrest and no others:
(1) 
He may arrest an offender without a warrant when the offense is committed in his presence or within his view, if the offense is one classed as a felony or as an offense against the public peace;
(2) 
He may lend physical aid to any regular member of the police department in making any lawful arrest when authorized by the chief of police or requested by any regular member of the police department of this city.

Members of the police reserve force may serve without compensation, but the city council may from time to time, by resolution, provide uniform compensation for members of the police reserve force. The compensation shall be based solely upon time served by a member of the police reserve force while in training for or in the performance of official duties.
(2003 Code, sec. 9.409)
(a) 
The city council may hereafter by resolution provide hospital and medical assistance to a member of the police reserve force who sustains injury in the course of performing his official duties.
(b) 
All police reserve officers injured as a result of duties performed in the course of his or her job as a reserve officer shall be eligible to receive worker’s compensation benefits through the city’s insurance carrier.

Every member of the police reserve force must give at least eight (8) hours of service each month to maintain reserve status. Failure to give such service shall be considered as a resignation from the police reserve force. Any member who has forfeited such commission may petition the city council asking for a reappointment. The city council shall consider all of the facts of the case in determining whether to reappoint that person or not.

Resignations by members of the police reserve force shall be submitted to the chief of police, who shall without approval of the city council be authorized to accept the same.
(2003 Code, sec. 9.412)
(a) 
Except as otherwise provided herein, members of the police reserve force are subject to the same rules, regulations, policies and procedures as members of the regular police force. Members of the police reserve force who violate any applicable rules, regulations, policies or procedures of the city police department are subject to disciplinary measures deemed appropriate by the chief of police.
(b) 
In addition to the penalties provided by law, any violation of law under color of the performance of his duties as a member of the police reserve force and any breach of rules and regulations established by the chief of police shall subject any member to summary expulsion, and the fact thereof may be published at the order of the chief.

(a) 
The chief of police shall prescribe the uniforms and badges for the members of the police reserve force and direct the manner in which the same shall be worn.
(b) 
An identification card or such other insignia or evidence of identity as the chief of police may prescribe shall be issued to each member, who must carry the card or other identification at all times while on duty and must surrender them upon termination of membership.
