An owner or his duly authorized agent or representative may make application for the amendment of the zoning regulations applicable to his property by filing with the city council a written application in such form and content as the city council may require. An application for amendment shall be accompanied by the payment of a fee in the amount of $150.00, which shall include the costs of notice and posting.

Upon receipt of an application, the city council shall set a date for public hearing not less than twenty (20) days nor more than sixty (60) days from the date of filing. Fifteen (15) days’ notice of the public hearing shall be given by the city council by publication in a newspaper of general circulation.

(a) 
The city council shall hold a public hearing on each application for amendment of zoning regulations, pursuant to the receipt of a fee set by the city council.
(b) 
If, after the public hearing, the city council shall by a majority vote of those councilmen present and voting find that an amendment of the zoning regulations promotes the purposes stipulated in section 14.01.001 of this chapter, then the city council by duly adopted ordinance shall order the “Zoning Map of the City of Canadian” to be amended. The ordinance shall include a delineation of the boundaries of the area amended.
(c) 
An amendment creating or modifying planned development shall require delineation of the boundaries of the area amended and provide the regulations for use in that area where specific regulations are not established by this chapter.
(d) 
The city council may approve the zoning regulation amendments as submitted, or approve the zoning regulation amendments subject to modification.

If a written protest against an amendment, change or repeal of this chapter or any part thereof is presented, duly signed and acknowledged by the owner of twenty percent (20%) or more of the area of the lots on land immediately abutting the territory included in such proposed change or separated therefrom only by an alley or street, and extending 200 feet therefrom, such amendment shall not be passed except by the favorable vote of four (4) members of the city council.
