It shall hereafter be unlawful for any person, firm or corporation to drill a water well in the city without a permit from the city. The permit must be received from the city council upon recommendation of the water and sewer superintendent and the city engineer.

The applicant shall first pay a fee in the amount set forth in the fee schedule in appendix A of this code and present his name, his address, the location of the proposed water well, the proposed depth of the well (within 25 feet) and the diameter of the proposed well. The proposed application shall be addressed to the city manager or his/her designee.

In considering approval or disapproval of the application, the water and sewer superintendent, the city engineer and the city council shall consider the health and public safety of the entire city as it relates to the depth of the proposed well, its proximity to public water supply wells and tanks and its proximity to public streets, alleys and thoroughfares.
