Except as otherwise provided in this Part, it shall be unlawful to operate any ATV on any public street or highway located within the Township of West Lebanon.

No ATV shall be operated on any property owned by the Township of West Lebanon or any other public body or agency within the Township of West Lebanon.

No track, trail or any other area shall be set aside for the operation of ATVs for sport or recreation on private property without securing a Zoning Permit pursuant to the provisions of Chapter 27, Part § 101 et seq. of the Township's Codified Ordinances and as may be required by the Township's Zoning Regulations.

While within the Township of West Lebanon, it is the duty of any operator and/or owner involved in an accident, personal injury, damage to property, loss of life and/or being given direction to stop by law enforcement officers, while operating any of the above-mentioned vehicles, to stop, render aid, and give information to officers and/or departments requesting information and/or reports.

Any ATV engaged in violating federal, state, or local laws will be seized, sold and/or destroyed by the Township or other local authority after notice and hearing in accordance with federal or state forfeiture laws.

The above provision shall not pertain to public safety agencies on patrol, during the course of patrol and/or while responding to emergencies and/or disasters.

Anyone found to be in violation of the provisions of this Part, upon conviction thereof, shall be sentenced to pay a fine of not less than $200 or more than $1,000 plus costs and attorney's fees. In default of payment of said fine and costs, a term of imprisonment can be imposed not to exceed 30 days.
