It shall be unlawful for any person to drive or cause to be driven, or operate or maintain, any motor vehicle, motor truck, trailer, or any other vehicle having thereon, or attached thereto, a tank or other receptacle used for the carrying of gasoline, butane, propane, methane, octane, pentane, or any other kind of liquefied petroleum or natural gas products, over any street or streets, alley or alleys, within the city, except the hereinafter specifically designated streets:
Bee Cave Road, also known as Farm to Market Road 2244, as it is situated within the city.

(a) 
It shall be unlawful for any person to park or cause to be parked on any street, road, or alley within the city any motor vehicle, motor truck, trailer, or other vehicle having thereon, or attached thereto, a tank or other receptacle used for the carrying of gasoline, butane, propane, methane, octane, pentane, or any other kind of liquefied petroleum or natural gas products, whether loaded, partially loaded, or empty of such liquefied petroleum products.
(b) 
This section shall not apply to any vehicle’s stopping on any of the designated streets at filling stations for service, or breakdown of such vehicles on such streets.

It shall be unlawful for any person to maintain any motor truck, motor vehicle, trailer, or any other vehicle having thereon, or attached thereto, a tank or other receptacle filled or partially filled with gasoline, butane, propane, methane, octane, pentane, or any other kind of liquefied petroleum or natural gas products, at any place within the city.

Sections 16.06.031 through 16.06.033 shall not apply:
(1) 
When any such truck, motor vehicle, or trailer:
(A) 
Is carrying gasoline to filling stations, commercial consumers, or bulk stations located within the city.
(B) 
Is carrying any of such products to be used exclusively for its own propulsion.
(C) 
Loaded or partially loaded, has stopped on any such designated streets, as provided in section 16.06.031, at a filling station or garage for necessary repairs, with the further provision that the vehicle shall not remain at such filling station or garage longer than 30 minutes, unless police authorities are notified that it is necessary to remain for a longer period than 30 minutes.
(D) 
Needs immediate repairs and is not loaded or partially loaded with any of such products and is on direct route to a garage or to the owner’s private property or place of business of the owner of the truck, motor vehicle, or trailer, or to the owner’s place of business exclusively controlled by the owner.
(E) 
Has broken down, has a flat tire or tires, or becomes out of repair or out of gasoline for its own propulsion to the extent that it cannot be propelled with its own power, providing the driver of such motor vehicle immediately notifies the police department of such forced stoppage, and if such vehicle as above described can be repaired within a period of two hours, then such repairs can be made where such vehicle has been forced to stop, providing that during such period for repair or repairs a police officer, or someone designated by him, remains at such place of stoppage to warn other persons, using the highway, street, or avenue, of such danger.
(F) 
Is loaded or partially loaded and has broken down and is out of repair to the extent that the same cannot be repaired within two hours, and the police authorities have been notified, and the same is being removed from such place of stoppage or breakdown to the garage or to some other place within the city by the public safety department.
(2) 
When any person is engaged in the business of:
(A) 
Hauling such liquefied petroleum products and has its place of business within the city such person shall have a right to convey such truck, motor vehicle, or trailer, described in section 16.06.031, to such place of business without police protection, provided such vehicle (excluding its own tank or receptacle and propulsion) is empty and free of all such petroleum products.
(B) 
Selling such liquefied petroleum products or natural gas products and is in the process of delivering such products to retail customers located within the city.

Any person violating any of the terms or provisions of this article shall be guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed $500.00.
