This division shall apply in and to all public parks, public recreation areas, and public swimming pools under the jurisdiction of the city.

When used in this division, the following definitions shall apply unless the context clearly indicates otherwise:
Boat.
A vessel not more than 65 feet in length, measured from end to end over the deck, excluding shear.
Firearm.
Any device capable of discharging a projectile through a barrel using the energy generated by an explosive charge or burning substance, or any device readily convertible to such use, including, without limitation, any pistol, revolver, rifle, shotgun, BB gun, air gun, spring gun, or other weapon in which the propelling force is gunpowder, a string, or air.
Headway speed.
The speed just fast enough so that the operator can steer the boat.
Large event.
A private event of 25 or more attendees, not open to the general public.
Motorboat.
Any vessel propelled or designed to be propelled by machinery, whether or not the machinery is permanently or temporarily affixed or is the principal source of propulsion.
Operate.
To navigate or otherwise use a motorboat or a vessel.
Outboard motor.
Any self-contained internal combustion propulsion system, excluding fuel supply, which is used to propel a vessel and which is detachable as a unit from the vessel.
Owner.
The person who rightfully claims lawful possession of a vessel by virtue of the legal title or an equitable interest.
Personal watercraft.
A type of motorboat that is specifically designed to be operated by a person or persons sitting, standing, or kneeling on the vessel rather than in the conventional manner of sitting or standing inside the vessel.
Pollution.
The alteration of the physical, thermal, chemical or biological quality of, or the contamination of, any public water that renders the water harmful, detrimental or injurious to humans, animal life, vegetation or property, or to public health, safety or welfare, or impairs the usefulness or the public enjoyment of the water for any lawful or reasonable purpose.
Public recreation area.
Any and all recreational areas usually open to the general public for recreational activities, including the Sandy Creek Arm.
Sandy Creek Arm.
The portion of Lake Travis waterway annexed within the city limits as shown on the official maps of the city.
Small event.
A private event of less than 25 attendees, not open to the general public.
Special event.
Any event open to the general public, including, but not limited to carnivals, fairs, festivals, picnics or barbecues.
Vessel.
Any watercraft or motorboat, other than a seaplane on water, used or capable of being used for transportation on water.
Vessel livery.
A business establishment engaged in renting or hiring out vessels for profit.
Weapon.
An instrument of offensive or defensive combat, or anything used, or designed to be used, in destroying, defeating, or injuring another, including, without limitation, a slingshot.

(a) 
Any person who shall violate any of the provisions of this division, or shall fail to comply therewith, or with any of the requirements thereof, within the city limits shall be deemed guilty of an offense and shall be liable for a fine not to exceed the sum of five hundred dollars ($500.00). Such penalty shall be in addition to all the other remedies provided herein and at law.
(b) 
Any person who shall remove a marker, buoy, sign or warning or notice device placed pursuant to this division from public property or the Sandy Creek Arm shall be deemed guilty of a misdemeanor offense.
(c) 
Any person who shall knowingly or intentionally provide false information on any permit application required pursuant to this division shall be deemed guilty of a misdemeanor offense.
(d) 
A boater’s safety course shall not be granted nor offered by the municipal court for violations of part IV or part V of this division except upon motion of the state by and through the prosecutor.

If any person violates or fails to comply with any provision of this division, after having been advised by an authorized enforcement agent of the city to cease such violation or failure, the city may require that person to leave any public park, public recreation area, or public swimming pool.

The park attendant is authorized to issue warnings and citations to any person or persons violating any rules or regulations applicable to the parks, swimming pools, or the waters of Lake Travis adjacent to the park areas of the city. The park attendant is also designated as a park patrol officer.

It shall be unlawful for any person to:
(1) 
Throw, discharge, or otherwise place or cause to be placed in the waters of any swimming pool, fountain, or body of water in or adjacent to any public park or recreation area any substance, matter or thing, liquid or solid, which will or may result in the pollution of the water.
(2) 
Take into, carry through, or put into any public park or public recreation area any rubbish, refuse, garbage, or other material.
(3) 
Fail to deposit any rubbish, refuse, garbage, or other material in receptacles provided in any public park or recreation area; where receptacles are not provided, persons shall carry rubbish or waste away from the park, and properly dispose of it elsewhere.
(4) 
Bring any glass container into any public park or public recreation area.
(5) 
Drive any vehicle within any public park or public recreation area at a speed in excess of five (5) miles per hour.
(6) 
Bring into or have in his or her possession any firearm or weapon in any public park or public recreation area.
(7) 
Have in his or her possession or discharge any fireworks within any public park or public recreation area, unless the city has issued a permit authorizing such possession or discharge.
(8) 
Camp or stay overnight anywhere within any public park or public recreation area.
(9) 
Be nude in any public park or public recreation area or a public body of water in or adjacent to the city.
(10) 
Cause, create, or contribute to any noise which emits sounds beyond the person’s immediate individual picnic or use site, whether by shouting or singing, by using a radio, phonograph, television, or musical instrument, or by operating mechanical or electrical equipment, between the hours of 10:00 p.m. and 8:00 a.m., unless such noise is occurring in connection with a city-sanctioned event.
(11) 
Light, build, or maintain a campfire or ground fire in any public park or public recreation or beach area, except in the facilities provided by the city, or by a city permit; provided, however, that portable charcoal grills may be used in picnic areas.
(12) 
Bring into or have in his or her possession any alcoholic beverages within any designated children’s activity area.
(13) 
Park any motor vehicle in a no-parking area, or disregard any barrier or sign placed in a public park or recreation area by the city.
(14) 
Sell or offer for sale any goods or services within any public park or public recreation area, unless the city has issued the person a permit to do so. Commercial and rental use of a public park or its facilities is prohibited. The launching or retrieving of rental watercraft and watercraft for hire is prohibited. The loading or unloading of passengers from such watercraft is also prohibited. Parking in Jones Brother Park by customers or operators of such operation is prohibited.
(15) 
Operate a motorboat or any other vessel that creates a hazardous wake or wash anywhere along the shore or beach of any public park or recreation area.
(16) 
Tow another person on water skis so that the skier comes within 50 feet of the shoreline of any beach in any public park or recreation area.
(17) 
Launch or retrieve any vessel at any area other than designated ramps in any public park or any public recreation area within the city.
(18) 
No person may operate a boat, vessel, motorboat or personal watercraft within 50 feet of the shoreline, structures, or swimmers at a speed greater than headway speed (the speed just fast enough so that the operator can steer the boat).
(19) 
Park any oversized vehicle, such as a motor home, travel trailer, RV, camper or bus, in a public park or public recreation area, other than authorized emergency vehicles or vehicles participating in a city-sanctioned event.

The public parks and designated public recreation areas of the city shall be open from sunrise to 10:00 p.m. It shall be unlawful for any person to be in any such park or designated public recreation area between 10:00 p.m. and sunrise; provided, however, that between 10:00 p.m. and sunrise any person may use the parks and recreation areas for the specific and limited purpose of fishing.

(a) 
The city shall establish and maintain regulations for Jones Brothers Park which shall be printed and made available at the park and which shall include fees that shall be adopted and included in the schedule of fees contained in appendix A to the city’s code, which is on file in the city secretary’s office and updated as the city council finds necessary to amend or revise such fee schedule.
(b) 
The regulations and fees so adopted shall address the following:
(1) 
Vehicles entering the park that belong to nonresidents of the city;
(2) 
Boat launching fees applicable to all persons;
(3) 
Waiver or revision of parking fees for city-sponsored events;
(4) 
Issuance of parking passes to visitors who rent park facilities such as the pavilions or picnic tables and which allow the parking of a specific number of vehicles during the rental time frame;
(5) 
A prohibition against parking vehicles in nearby neighborhoods so that park users may walk into the park, including towing of such vehicles;
(6) 
A limitation on the number of visitors to the park and the number of vehicles allowed in the park, including boat trailers;
(7) 
Prohibition against allowing walk-ins when the park is closed;
(8) 
Entry and boat launch regulations applicable to non-residents that will not apply to residents of the city;
(9) 
Annual passes, to be displayed on windshields or dashboards, that identify park users as citizens or non-citizens of the city;
(10) 
Protection of access to homes on Lakeside Drive, including provision for delivery vehicles, mail, contractors, repairmen, and residents’ visitors;
(11) 
Control of access to the park at both the Park Dr. and east Lakeside Dr. entrances; and
(12) 
Provisions for vehicles pulling trailers to be able to safely turn around and to leave the park.
