(a) 
The holder of a mixed beverage late hours permit issued by the state may sell and offer for sale mixed beverages in the corporate limits of the city between midnight and 2:00 a.m. on any day in accordance with the Texas Alcoholic Beverage Code (“TABC”) section 105.03.
(b) 
The holder of a retail dealer’s on-premises late hours license may sell, offer for sale, and deliver beer between midnight and 2:00 a.m. on any day in accordance with section 105.05, TABC.

In the event of a conflict between this division and section 105.03 or section 105.05 of the TABC, the TABC shall control. Terms used in this division that are defined in the TABC shall have the meaning set forth in the TABC.

Any person, firm or entity who sells, offers for sale, or delivers the alcoholic beverages outside of the hours set forth in this division shall be deemed guilty of an offense and shall be liable for a fine not to exceed more than $500.00. Each day the violation exists shall constitute a separate offense. Proof of a culpable mental state shall not be required to establish a violation of this division.
