Every officer, agent or employee of the city, while responding
to emergency situations, is hereby authorized to act in such a manner
as to most effectively deal with the emergency. This provision shall
prevail over every other ordinance of the city and, to the extent
to which the city has the authority to so authorize, over any other
law establishing a standard of care in conflict with this section.
Neither the city nor the employee shall be liable for any failure
to use ordinary care in such emergency.

The city council has and reserves the right at all times to
fill the office of city secretary, tax collector-tax assessor, city
treasurer, and also city [attorney] by appointment inasmuch as these
are appointive and not elective offices.

(a) The
city council does hereby adopt comprehensive substance abuse policies
and testing procedures therefor to assure as fully as possible to
the citizens of the city public servants who shall be free of such
abusive practices. A copy of these policies is attached to Ordinance
450 as exhibit I.
(b) Any
public employees of the city testing positive for unauthorized controlled
substances and/or intoxicating beverages shall be subject to removal
from such public service. All prospective employees of the city shall
be refused consideration for such employment or appointment if they
also test positive from such screening.
