It shall be unlawful for any person, firm, or corporation, other than a holder of a current franchise contract with the City of Pineland, to collect, transport, or dispose of, or attempt to collect, transport, or dispose of any solid waste originating within the corporate limits of the City of Pineland, except as hereinafter provided.

(a) 
Residential.
Residential solid waste collection fees are hereby established as set forth in the fee schedule in the appendix of this code.
(b) 
Commercial.
Commercial solid waste collection fees are hereby established as set forth in the fee schedule in the appendix of this code.
(c) 
Refuse Collection Required; Penalty for Violation.
All residential and commercial customers are required to have city garbage pickup service. Violators are subject to a penalty, the amount of which to be set by the municipal judge.
(d) 
Refuse Service Charge Collection Policy.
The charges fixed under the terms and provisions of this article shall be a charge against the owner, occupant, or lessee of the premises, and the amount so fixed shall be collected through the utility department monthly as utility charges are collected. Utility service will be discontinued for failure to pay the charges herein established in the same manner as service is discontinued for failure to pay any utility charges and the failure to pay the charges herein established shall subject the customer to the same penalty as prescribed for failure to pay any utility charge. Any person making application for any utility service shall be deemed to have applied for garbage service and shall be considered a customer of the refuse division of the city until such times as utility service to such person has been discontinued.

The policies for the collection of refuse and garbage within the City of Pineland shall be as provided for in an agreement between the City of Pineland and the franchise holder providing such service.

Dogs, cats, and other dead animals shall not be placed in garbage containers. The dead animal pick up service of the City of Pineland will, upon notice to do so, remove such small dead animals. Larger animals shall be removed by and at the expense of the owner to a proper place for disposal and buried to a sufficient depth to eliminate any health hazard or other nuisance within twenty-four (24) hours after death.

It shall be unlawful for any person, firm, or business to place or throw or permit to be placed or thrown any garbage, brush, loose waste, or refuse of any kind, on public or private property outside of any house or building in the City of Pineland unless the same has been deposited in accordance with the provisions of this article or any other ordinance of the City of Pineland pertaining to littering or nuisances.

It shall be unlawful for any person to meddle or tamper with any garbage can or receptacle, or any trash or rubbish receptacle, or to scatter the contents thereof in any street, alley, sidewalk or premises in the city.

It shall be unlawful for any person, firm, or corporation to move, haul, or transport garbage, trash, or rubbish upon any street or highway in the City of Pineland unless such person shall transport the same in containers or vehicles in such a manner as to prevent the falling or blowing of the garbage, trash, or rubbish from such vehicle onto the street or highway.

Only the duly authorized agents and employees of the city shall collect refuse, empty refuse containers, or transport refuse, garbage, or trash on the streets, alleys, or public thoroughfares of the city without a written permit granted and issued by the city council, with the exception that Pineland residents and businesses and industrial firms that use a vehicle rated less than a one (1) ton to haul their own refuse shall not be required to have a permit.

(a) 
Only residents and businesses of the City of Pineland shall dispose of refuse at the city sanitary landfill. The sanitary landfill shall be open to the public on Wednesday and Saturday between the hours of 9:00 a.m. and 12:00 noon.
(b) 
Disposal service charges shall be as established by the city council.
(c) 
The public utilities superintendent shall have the authority to cause to be rejected for disposal any material that in his judgment would create a nuisance by reason of emission of disagreeable odors or would operate to make the disposal facilities adversely affect the public health, safety, and welfare of the citizens of Pineland. It shall be unlawful for any person to take away from the sanitary landfill site operated by the city, any garbage, rubbish, or trash, article, thing, or object situated at the site, whether or not the same has monetary value. In prosecutions for this offense, it shall not be necessary to allege that the same had value.
(d) 
Any person entering upon a city operated disposal site for any purpose shall be conclusively presumed to know and appreciate the hazards and the extent of the damage which accompanies the accumulation of scrap wood, glass, nails, trash, brush, waste, and garbage of every description and the use of trucks and vehicles and heavy machinery to move, remove, and bury same, and every person entering upon any such site shall be conclusively presumed to have assumed the risk of injury connected with or resulting from such hazards and danger by his or her action in entering upon such site and for and in consideration of the permission granted by the City of Pineland to enter upon such site; every person shall convenant and be deemed to have covenanted not to sue and to indemnify, save harmless and defend the City of Pineland its agents, officers, and employees from and against any and all claims of any nature whatsoever for injury or damage to person or property, whether real or asserted, arising out of or resulting from the entry by such person upon any city operated refuse disposal site.
(e) 
The head of the utility department may require special kinds of containers for collection of wastes when he determines a normal container would be inadequate, and may determine that certain items need not be contained. In so doing, he may make rules and requirements for the collection thereof.
(f) 
Items not placed for collection in appropriate containers, or under the provisions hereof, shall constitute “litter” as prohibited in this article, and the penalties therefore shall be applicable.

It shall be unlawful for any individual, business or entity that is not an owner, occupant, or lessee of premises within the city limits and therefore does not qualify for service or pay service charges for the city solid waste collection services to place garbage or waste for collection within the city limits. It shall also be unlawful for any individual, business, or entity that does qualify and receive city solid waste collection services to place garbage or waste for collection within the city if such garbage or waste is not generated or accumulated from that individual, business, or entities normal residential or business activities within the city limits of Pineland, Texas. Violations of this provision of the ordinance code shall be punishable by a fine in accordance with the general penalty provision in Section 1.109 of this code.
