This division applies to all waters impounded by a dam constituting Brady Lake and adjacent lands owned and controlled by the city, herein referred to as the lake. Certain areas adjacent to the lake have been set aside for future development by the city as public parks and picnic areas, or other uses as designated.

The lake and adjacent city property will be patrolled by the city police department. Officers will have full arrest authority to enforce city, state and federal laws on the lake and surrounding property.

The city shall have full charge and control of the waters and grounds of the lake. The city may lease lake property to individuals from time to time for private or commercial purposes.

Possession or firing any firearm, except by licensed peace officers, is prohibited on the waters and grounds surrounding the lake. No hunting is allowed on city property. No detonation of fireworks except by trained personnel during authorized city fireworks displays is permitted.

(a) 
Whereas the waters of Brady Lake constitute a source of public drinking water, and whereas that water must be protected from contamination, the following rules apply:
(1) 
Garbage, trash, rubbish, litter or any other waste material generated on the waters of Brady Lake or public areas surrounding the lake and incidental to authorized recreational activities shall either be removed to permitted disposal sites, or deposited in receptacles provided by the city for that purpose. Improper disposal of such wastes, or human and animal wastes, is prohibited.
(2) 
It is a violation to bring to Brady Lake or public areas surrounding the lake any household or commercial garbage, trash, rubbish, debris, dead animals, or litter of any kind for disposal or dumping.
(3) 
The spilling, pumping or other discharge of contaminants, pollutants or other wastes, including but not limited to human or animal waste, petroleum, industrial and commercial products and byproducts, into Brady Lake or public areas surrounding the lake is prohibited.
(4) 
The discharge or placing of sewage, galley waste, garbage, refuse, or pollutants into the waters of Brady Lake from any boat or watercraft is prohibited.
(5) 
Campers, picnickers and all other persons using public areas surrounding the lake shall keep their sites free of trash and litter during the period of occupancy and shall remove all personal equipment and clean their sites upon departure.
(b) 
A reward in the amount of $50.00 will be paid by the city to anyone reporting violations of subsections (a)(1) through (4) of this section to the police department when the information results in arrest.

The roads not paved on city property around the lake shall be considered dry weather roads. These roads may not be used for the operation of vehicles during wet weather, which causes damage to the roads. Such damage will be considered criminal mischief, and in violation of this article.

(a) 
Destruction, injury, defacement, removal or any alteration of public property, including, but not limited to, developed facilities, natural formations, mineral deposits, historical and archaeological features, and vegetative growth, is prohibited.
(b) 
Cutting or gathering trees or parts of trees and/or the removal of wood from city-owned property is prohibited. Gathering of dead wood for use in designated recreation areas is permitted.
(c) 
The above and foregoing prohibitions on cutting and removal of trees and vegetation do not apply to vegetation control programs by or under the control of the city.

It shall be unlawful to leave any vehicle on city-owned property in the lake area unattended for more than twenty-four (24) hours. The chief of police or his representative is authorized to remove such vehicles.

Certain areas of the shoreline of the lake are private property, and access to these areas and private docks are restricted to owners and guests.
(1) 
Property in the Simpson Lake Club Addition fronting the lake, occupied by private docks, private property and docks belonging to residents in the Winters Addition, and private docks located in the Dodge Heights Addition.
(2) 
The area lying north of FM Road 3022, between the south end of Brady Lake Dam on the east and the city limits on the west, known as the gun range.

(a) 
Due to concerns regarding the safety of persons diving or jumping from the Bear Creek Bridge on FM 2028, it shall be unlawful to dive or jump from any bridge on a public roadway or any pedestrian bridge in the city limits.
(b) 
It shall be unlawful to fish from any bridge on any public roadway within the corporate limits of the city.

(a) 
Construction of docks and other structures.
No dock or docks or any floating structure shall be placed on the waters of Brady Lake for use as a stationary structure without prior approval of the city. All such structures shall be referred to by definition as docks and shall include piers, floating walkways or other structures. All docks placed off the waters of the lake shall be constructed with styrofoam or polystyrene flotation. No metal drums or barrels shall be used. All materials used in construction shall be sound and no floating structure may be placed on the lake waters unless the design and materials are approved by the city.
(b) 
Size of docks.
No docks larger than 24 feet by 30 feet may be placed on the waters of the lake.
(c) 
Location of docks.
In determining the location of docks, the following policies and priorities will govern the location approved by the city:
(1) 
Owners of waterfront lots in any subdivision at the lake will have first priority as to placement of docks.
(2) 
Owners of lots in any subdivision not adjacent to the shoreline will have second priority as to locating docks.
(3) 
Approval will not be given to persons wishing to locate docks who do not own property within the subdivision.
(4) 
No docks will be located closer than 20 feet to any existing dock, or located in any manner that will interfere with safety of, or lake access to, existing docks. Docks shall not extend more than 50 feet from the shoreline without approval from the city manager.

(a) 
The city manager or his representative may inspect docks from time to time as required. Owners of any dock found to be unsafe or in such disrepair as to create an unattractive nuisance shall be instructed to repair the structure to appropriate safety and visual condition.
(b) 
Failure of dock owners to comply by returning the dock to an acceptable state of repair may result in revoking of approval for the structure, and removal of the dock by the city.

The existing laws of the state governing minimum length, daily bag and possession limits will apply.

The area of Brady Lake known as the marina is designated for commercial use as an all weather protected fishing area. Fishing from this location is operated under a concession for paid fishing. No boats may fish within 100 feet of the marina.

(a) 
All boats and personal watercraft operating on Brady Lake will abide by the provisions of the Texas Water Safety Act.
(b) 
All boats operating on the lake shall be operated in a safe manner, at a reasonable and prudent speed. Boats will obey no wake areas, and remain clear of other boats and fishing and swimming areas. Personal watercraft will be operated in a safe manner, remaining clear of boats and other craft.
