It shall be unlawful to burn trash, brush, tree limbs, grass,
trees, leaves, paper, boards, planks, lumber or any other character
of debris or inflammable materials whatsoever in the city limits,
except in an incinerator or container, which has been approved in
writing by means of a permit by the city fire officials and said incinerator
or container shall be located so that smoke will not become a nuisance
to occupants of surrounding buildings; nor shall said incinerator
or container create a hazard to surrounding property.

(a) Whenever it becomes necessary to burn vegetation (i.e. grass, leaves, limbs, etc.) out-of-doors in the city limits, for any purpose whatsoever, except in an incinerator or container as provided in section
5.06.001, and except as provided in section
5.06.003, said person shall first be required to obtain a permit in writing for such fire from the city fire chief or fire marshal. Said permit shall be issued only if, in the opinion of the city fire chief or city fire marshal, the time and place of said fire is not dangerous to adjoining or nearby property. Said fire shall be supervised by the person obtaining the permit, and he shall not leave it unguarded at any time while it is burning. No open fire shall be permitted until one hour after sunrise nor later than one hour before sunset.
(b) The
permit shall contain the following:
(1) Type material to be burned;
(5) Material to be stacked in small piles in the center of the area;
(6) The permittee to assume all liability and responsibility.

fire marshal will provide an application for outdoor burning.

Whenever it shall become necessary for any person to have a
fire out-of-doors for cooking, washing, or any other purely domestic
purpose, such person is hereby required to build such fire in a fireproof
container of some kind, made of brick, stone, metal or other fireproof
material in such manner as to prevent said fire from escaping.

The burning of garbage in any form, or petroleum products, or
automobiles, or other motor vehicles or any part thereof for wrecking
or salvage purposes in or on any lot or other premises within the
city limits is hereby prohibited.

It shall be unlawful for any person to light or have lighted
any fire in any street, alley, thoroughfare, or public property.

This article shall not relieve a person, firm or corporation
from paying their regular garbage fees as required by the garbage
regulations.

It shall be unlawful to burn trash in a garbage container.

Any person violating this article or any part thereof shall, upon conviction, be guilty of a misdemeanor and shall be fined in accordance with the general provision set forth in section
1.01.009 of this code. Each day that said violation continues shall be considered a separate offense.
