There is hereby created and established for the city a court to be known as the municipal court.

The municipal court shall be presided over by a judge to be known as the judge of the municipal court. The judge is to be appointed to this position by the city council, and the judge so appointed is not required to be a licensed attorney; however, such judge shall be a citizen of the United States and a citizen of the state.

The term of office of the judge of the municipal court shall be for a period of two (2) years, and the judge first appointed shall hold his term of office corresponding to the unexpired term of the mayor, and every two (2) years thereafter a judge shall be appointed for a term of two (2) years.

Any vacancy in the office of the municipal judge by death, resignation, or otherwise shall be filled by the city council, which may appoint some qualified person to act in place of the municipal judge; and the appointee shall have all of the powers and discharge all the duties of the office and shall receive the same compensation therefor as is payable to the regular municipal judge while so acting.

The municipal judge presiding over the municipal court shall keep all municipal court records and perform all the regular duties of clerk, and such judge shall have all other duties and powers conferred on municipal judges by the laws of the state.

The municipal judge may be removed from office during the term for which he was appointed for incompetence, inefficiency, official misconduct, or for good cause. However, such judge shall not be removed until he is given due notice of the grounds for removal and is given an opportunity to present a defense and oppose said grounds of removal in a hearing before the city council.

The municipal judge shall receive a salary to be set by the city council, which salary may not be diminished during his or her term of office.
